Q. There seems to be some legal question in this, Governor, and I
was wondering if you had had a chance to discuss it with the Attorney
General. I am pretty certain that some people might have contacted
you yesterday to discuss it with you. The question is: I checked with
the Secretary of State's office yesterday and confirmed the fact that
you did reappoint Judge Byrnes last November. (Governor: That's
right. ) It is my understanding that the appointment runs through —
runs up to the election. Now if Judge Byrnes for instance would
choose to resign his position from the Bench prior to the Primary
Election do you have knowledge whether you would make a judge-
ship appointment?

A. Yes, I would make the appointment and that appointee would
not come up until two years.

Q. Now, let's go the other way. Suppose Judge Byrnes would decide
that he does not want to submit his resignation until after the Pri-
mary Election. Do you know where that would leave you with —

A. I think the same place.

Q. That's a big hassle. If Judge Byrnes resigns before the election,
do you intend to exercise your prerogative and appoint the judge?

A. Well I would certainly, if there is some doubt about it, which I
wasn't conversant with, I would ask the Attorney General for an
opinion, and if it's proper for me to appoint a successor I would do
so. He won't come up in this election.

Q. Were you at all troubled or frightened by the large and en-
thusiastic crowd that came out to hear Governor Wallace?

A. No, I wasn't there.

Q. Did it bother you at all that there were so many Wallace sup-
porters in this State?

A. Not particularly, because I don't think there were that many of
them involved. What was it? 6000 people — we have now almost —
I think almost — 4 million in the State. That's not a large number
of people.

Q. Doesn't it compare very well to most political rallies, Governor?

A. I suppose it does, but at most political rallies the utterances are
more traditional.
