Therefore it is Considered by the justices here the 2 ist Day of May Anno
Dom 1728 aforest that the said Thomas Brooke Recover against the said
Michll Macnemara Son and Heir of the afsd Thomas Macnemara As Well
the Sum of four Hundred and Ninety Seven Pounds fifteen shillings his Debt
afsd as also the Sum of One thousand four Hundred and Ninety Nine Pounds
of Tobacco by the Court here adjudged Unto him for his Costs and Damages
Sustained by Occation of Detaining the same Debt And the Defendant in
Mercy etc: Afterwards in the Same Court or Term the said Midi": Macne-
mara by his Attorneys Afores'1 Prays an Appeale from the judgment of this
Court in the Premisses aforesaid to the High Court of Appeals Which is
Granted by the Court here And it is Ordered that the Record and Proceed-
ings thereof be transmitted Accordingly. Whereupon the said Michll Mac-
nemara Lodges in Court here his Bond for the Due Prosecution of the
Appeale afsd the Tenour of Which followeth in these Words. Vizf:
Know all men by these Presents that Wee Michll Macnemara Charles
Carroll Esqr and Charles Carroll Chirgeon [sic] All of the City of Annapolis
Are held and firmly bound Unto Thomas Brooke of Prince Georges County
Esqr in the just and full Sum of Eight Hundred and Ninety Nine Pounds
Sterling And Ten thousand Pounds of Tobacco to be Paid to the Said
Thomas Brooke his Executors Administrators or Assigns to the which Pay-
ment to be well and truly Made Wee Hereby bind Ourselves and Each of Us
Our Heirs Execr" Admr" and Assigns and Every of them joyntly and Severally
by these Presents Sealed With Our Seales And Dated this Twenty Seventh
Day of May Anno Domini One Thousand Seven hundred And Twenty Eight
The Condition of the Above Obligation is Such that if the above bound
Michll Macnemara Do and shall Prosecute an Appeale brought by the said
Macnemara on a judgment Obtained Against him the Said Midi" Macne-
mara by the Above Named Thomas Brooke in the Provinciall Court of
Maryland With Effect in the High Court of Appeals And also Satisfye and
Pay to the said Thomas Brooke his Exrs admrs or Assigns in Case the said
judgment shall be Affirmed as well all and Singular the Costs Adjudged by
the Provinciall Court as also all Costs and Damages that shall be Awarded by
the said High Court of Appeals And Alsu if the said Mich" Macnemara shall
Persue the Directions of an Act Entituled An [814] Act for Regulating
Writts of Error and Granting Appeals from and to the Courts of Common
Law then the Above Obligation to be void Else to Remain in full force
