612 MARYLAND COURT OF APPEALS

prayed judgment if the Said Richard Smith Condemnation of the Premisses
So as afsd attached Against him to have Ought etc: And the said Richard Said
that he by Any thing Above Alledged from having Condemnation of the
Premisses against the said Thomas Brooke Ought not to be Precluded Be-
cause said That the said Thomas on the Day of laying the the [sic] same At-
tachment in his hands Vizt: the first Day of September in the Year of our
Lord Seventeen Hundred And twenty two had of the Goods Chatties and
Creditts of the Said Arden in his hands to the Value of the Money and To-
bacco in the Attachment Afsd And the return thereof Mentioned To Witt at
Prince Georges County afsd And this he prayed Might be Enquired of by the
Country and the Said Thomas Brooke Esqr Likewise Whereupon for trying
the issues Aforesd Command was then given to then sherriff of Prince
Georges County aforesd that he should Cause to come before the justices of
the Provinciall Court [809] At Annapolis the third tuesday of May then
Next or before the justices Appointed to take the Assizes in his County if
they should before that time To Witt on Friday the first Day of May then
next to the County Court house in his County Came twelve Good And Law-
full men of his Balywick by whom etc: Who Neither etc: To recognize etc:
Because As Well etc: Afterwards the Process Continued Between the Parties
afsd on the Plea Aforest by the jury being put thereon in Respite there Untill
the third tuesday of May then next Unless the justices of his Lordship the
Lord Proprietary to take the Assizes in the said County Assigned on Friday
the first Day of May then Next to the County Court house in the Said County
should have Come And then And there at that Day Vizt: the third tuesday of
May being the Nineteenth Day of the same Month In the Year of our Lord
Seventeen hundred And twenty four Came Again before the justices of his
said Lordships Provinciall Court there As well the said Richard Smith junr
by his Attorney Afsd As the said Thomas Brooke Esqr in his Capacity afsd by
his Attorney Aforest But the sherr: had not sent his Writt thereupon as be-
fore Command Was Given to the then sherr: of Prince Georges County that
he should Cause to Come before the justices of the Provinciall Court at An-
napolis the third tuesday of October then next or before the justices Ap-
pointed to take the assizes in his County if they should before that time To
Witt on Friday the twenty fifth Day of September then Next to the County
Court House in his said County Come twelve Good And Lawfull men of his
Bailywick to recognize in forme Aforesd Afterwards the Process Continued
Between the Parties Aforesd on the plea Aforest in form Afsd untill the third
tuesday of October then Next Unless the justices of his Lordship the Lord
Proprietor to take the Assizes in the Said County Assigned Should on friday
the Twenty fifth Day of September then Next to the County Court House
in the Said County Come at which said third tuesday of October To Witt the
twentieth Day of the same Month In the Year of Our Lord Seventeen Hun-
dred and twenty four before his Lordships Justices of the Provinciall Court
