Precept That You Shall make known to Our said Court att the Day afsd and
have You there this Writt att wch Day this is to Say the 10th Day of February
in the 42nd Year of the Dominion of Caecilius etc: Annoque Dom: 1673 John
Allen Gent High Sherr: of Charles County returns the Said writt Endorst as
follows Vizt: by Virtue of this Writt by John Grubb and Clement Thompson
good and Honest men of my Bailywick made known Unto the widow of the
Within Named Walter Beane that she be and Appear at the Day and Place
wthin Contained to shew Cause if any she have as by the writt within I am
Commanded John Allen Sherr: Whereupon Elianor Beane Widow of the
said Walter Beane being Called Did Appear by her Son in Law Mathew Hill
of Charles County Who Surrendred Up the Afsa Grant of the Land Called
Durham into the hands of the said Lord Propry and the Court ordered the
same to be Canceld which was Done by tearing of the Seale in Open Court
and further ordered that the record of the said Patent be Vacated obliterated
and Scored out by the HonMe the Chancellor of this Province and this Court
Do adjudge order and Decree the Said Parcell of Land Called Durham in
the said Patent named to be seized into the hands of the Lord Proprietary
and that the said Lord Propry Notwithstanding the Grant afsd by the sd Walter
Surreptionally Obtained is Lawfull and Right owner of the sa Land Premisses
and Every Part and Parcell thereof and the same may Possess or Dispose of
at his pleasure. We find that in the Margin of the Leaf Whereon the Said
Patent of the i7th Sepr 1666 is recorded and now remaining amongst the
Records in the Lord Proprietaries Land office the following Note or Writ-
ing is Made Vizt This Patent Within Pangaya Mannor and Surrendred into
the Chancery by the Widdow of Walter Beane and there Cancelled February
the 13th 1673 Vide order Lib: Chan: R.ll fol: 51

[782] We also find that at a Sessions of Assembly held in A province of
Maryland on the Day of in the year 1719 the following Bill
passed through the Upper and Lower Houses of Assembly and Was assented
to by the then Governour of Maryland Vizt: An Act for relief of John Beale
of Charles County Gentn and Richard Beal a minor Whereas Walter Beane
of Charles County Planter Deced by Virtue of a Warrant issued out of the
Land office the tenth Day of December Anno Dom: Sixteen Hundd Sixty
three had Surveyed and Laid out for him a tract of Land lying in Charles
County Called Durham Containing Seven hundd and fifty Acres and Aft-
erw"8 To Witt the Seventh Day of September Sixteen Hundd Sixty Six ob-
tained his Lordships the Right Honble Caecilius late Lord Proprietor of Noble
memory his Grant for the said tract of Land Undr the Conditions of planta-
tion Then in force which tract of Land Was by the said Walter Beane by his
Last Will and testament in Writing bearing Date the twelfth Day of April
Sixteen Hundred and Seventy and duly Proved Given and Devised unto his
Daughter Elianor an Infant in fee Simple and Shortly after dyed And
Whereas after the Death of the said Walter Beane and during the Minority
