all the Judgments after November Court This Deft doth further Say that
without the Least Combination or Confederacy with the Said Brewerton to
Defeat the Complainant of his Just Right or any other person that before
the Said Brewerton was Served with any manner of writt by the Said Cald-
well and before the Supposed Extent in the Complainants Bill mentioned
he this Defendant bona fide for a good and Valuable Consideration had a
Demise from the Sd Brewerton of one hundred and Sixty Acres of Land more
or less part of Smiths Adventure in fee Simple without any trust or for the
use of the Sd Brewerton or any other for his use that it is true that Some Time
in the Spring in the year 1719 the Sa Brewerton made over to this DeP his
Cattle in trust that he the Sd Brewerton might have the benefitt of their
Milk that Spring that the Same year this Deft delivered up the Same Bill of
Sale to the Sd Brewerton before the Execution of the Elegit and told Sd
Brewerton he would be no further Concerned and then and there disclaimed
any property in Said Goods and before the Sherr Jury and Complt at the
Execution of the Elegit Disclaimed any property in the Sd Brewertons Goods
and then offered to the Sherriff Some Goods the Sd Brewerton had Lodged
in the Defts house wch the Sherriff Declined to receive That the S" Brewerton
Likewise was Sued in Two Actions by the Complt at August Court the Same
year to Which Sd Actions this Deft became Special Baile for the Sd Brewer-
ton and the Said Brewerton made over to him this [757] Deft the rest of his
Land for his Security and Indemnification that the Sd two last Judgmts have
Since been Discharged by Sd Brewerton that this DeP hath always Since the
Sd Brewerton discharged the Sd Two Last Judgments been ready and willing
to reconvey to the Sd Brewerton or to any other person by his order the Sd
Last mentioned Land and therefore this Deft is Somewhat Surprized at the
Complts manner of proceeding Agt him without any Just Cause without that
That there was any Bargane and Sale made of any Land by the Sd Brewerton
to this Deft after the Same Execution or with any Intent to Defraud any the
Creditors of the Sd Brewerton wthout that That any other matter or thing
in the Sd Complts Sd Bill of Complaint Contained Materiall Material [sic] for
this Deft to answer unto and not herein and hereby well and Sufficiently an-
swered Traversed or Denyed is true all wch matters and things this Deft is
ready to mantain and prove as this Honrble Court Shall award and humbly
prays to be hence Dismissed with his reasonable Costs and Charges in this
behalf most wrongfully Sustained
