560 MARYLAND COURT OF APPEALS

Judgmt when it was very Valuable he remembers not the Sum Exactly but
refers himself for the Certainty of unto the Records of the Courts where the
Judgmts were rendered agt him that the Def was Seized of Some Lands in
Somersett County One hundred Acres Whereof was Demised for Ninety
Nine Acres to One John Waltham for a very Small Acknowledgmt of wch
Term good part was Expired whose Right was purchased by the Said Adams
that the Deft Agreed to Sell his right to the Sd One Hundred Acres to the
Said Adams and to Convey him Sixty Acres more of Rich Land that was
Contigous to the Said One hundred Acres and whereof the Deft was Seized
and possessed for the Quantity of Seven Thousand pounds of Tobacco on
purpose to Discharge the Debt Due to the Complt and had the Said Adams
Bond to pay all the Charges that the Complt Should put him this Deft to that
the Said Adams not paying the Debt due to the Complt was told by the Deft
that he Expected to be Sued by the Complt the Sd Adams told this Def that
he must follow his directions and he would pay the Charges and Afterwds
Directed him to keep out of the Sherriffs way that the Sa Adams keept the
Deft Concealed from the Sherriff in a house belonging to him for a Time
and then Deed was prepared (as he the Sd Adams pretended) for the one
hundred and Sixty Acres Sold him by this Deft which Deed as this Deft be-
lieves and hath been informed includes Considerably more than the Hun-
dred and Sixty Acres which the Deft partly throug ignorance and partly
through the Confidence he reposed in the S" Adams Executed

That this Deft much about the time (to the best of his remembrance)
that the Complt Sued him in the County [754] Court he this Deft in order
to Pay the Complt Applied himself to the Said Adams for the Tobo he was
by Agreemt to Pay for the Land wch the Said Adams refused to pay to him
Alledging that he was to pay it to the Complt upon wch the Deft desired the
Sd Adams Soe to do but received Some Slight Answer from him wch the Def
doth not Particularly remember That the Said Adams not paying what was
due to the Complt and the Def hearing that the Complt Intended to have
Execution of the Deft Lands and Goods told the Said Adams he Should
Loose all his Land that the Sd Adams Said he believed So too and advised the
Def To make the Same over to Some Person he Could Confide in for a Time
to avoid the Comts Execution that the Def Demised the Same for Seven
years to one John Leatherbury who did not medle wth it and afterwts Con-
veyed the Same for the purpose already mentioned in fee Simple to the Sd
Adams for the pretended Consideration of four Thousand Pounds of Tobo
Though not one pound thereof was ever paid that this Def knows of or to
be paid the Said Adams pretending at the Same time that he wished Some
other person would act in it rather than himself but however that he would
Doe it in friendship to the Def that the Sd Adams promised to give the Def
a Bond in the Penalty (to the best of his remembrance) of one hundred and
