MARYLAND COURT OF APPEALS 557

That Yr Petitioner Conceives he is Agrieved by the Sd Decree for that
it is not Agreeable to Equity and humbly beggs Leave to Appeale from the
Said Decree to the High Court of Appeals on the Petitioners Entering into
Bond for the Due prosecution of the Said Appeale and that Transcript of
the Proceedings in this Court relating to this Cause may be made out to be
filed with the Clerk of the Court of Appeals that yr Petr may According to
the usual Time file his reasons in the Court of Appeals.

And Yr Petr as in Duty Bound will ever pray

On the fourth Day of May Anno Dom Seventeen hundred Twenty and
Seven his Excelly the Chanclr granted the aforegoing Petn upon giving good
Security in Three hundred pounds Sterling Penalty for the Due Prosecuting
of the Appeale mentioned in the Petn afd

Thereupon the fifth Day of May afd the Said Alexander Adams with Ja"
and Henry Donaldson his Sureties Signed and Executed a Bond in the
Penalty aforementioned for the Due Prosecuting the Appeale afd wth Effect
from the Said Decree of the High Court of Chancery which Decree and the
Whole Proceedings thereunto relating (amongst other things in the Records
of the Chancery Court) are as follow Vize

MARYLAND sst At a Chancery Court held at the City of Annapolis in
Ann" County on Tuesday the i6th Day of Febry in the ioth year of his Lord-
ships Dominion etc. Annoque Dom 1724.

John Caldwell v Adams and Brewerton

Be it Remembred that Heretofore (To Witt) the fifth Day of Augt
Anno Dom one Thousand Seven hundred Twenty and one before the
Honrble Wm Holland Esqr then Chancellor of Maryland and Keeper of the
great Seale thereof came into his Lordships the Right Honrble the Lord
Propry's High Court of Chancery John Caldwell of Somersett County and

Exhihifterl his Rill of Complaint Agt Alexander Adams Clerk and Wm Brew-
erton of the Same County in the following words Vizt

To the Honrble Wm Holland Esqr Chancellr of Maryland Most Humbly
Complaining Sheweth unto yr Honour yr daily [sic] Oral1" John Caldwell of
Somersett County that one Wm Brewerton of the Same County became In-
debted to yr Oratr in a Considerable Quantity of Tobacco at a Time when
Tobacco was very Valuable wch the Sd Brewerton Through the Instigation (as
yr Orator believes and Doubts not to Prove) of one Alexander Adams Clerk
refused to pay Wherefore Yr Orator to his Inclination was Constrained to
Commence his Action or Actions at Law Agt the Said Brewerton in Somer-
sett County Wherein he recovered Damages and Costs of Wch Recovery he
Could have the disired Effect Through the Artifices of the Sd Adams who
