in his Clients favour he will become Security for the Said Bagby his prosecut-
ing an Appeale in this Case in the name of the Said Rogers and his Wife If
the Said Hon^ble Court Would please to Admitt thereof And Likewise declares
himself ready to Assist the Said Bagby with Whatever may be necessary for
his Carrying on and prosecuting the Said Appeale in the forme in Which he
prosecutes it. Which he hopes this Court Will not Take any Ways ill or
inconsistant with his duty of an Advocate or Solicitor in this Case. Where-
upon afterw^ds on the S^d Sixteenth day of July in the Same Court or Term
the Said John Bagby Come hereinto Court and Acknowledged themselves
Joyntly and Severally to Owe and stand Justly indebted to the Said Dorothy
Smith in the Sume of fifty Pounds Sterling to be paid to the Said Dorothy
Smith on Condition that in Case the Said John Bagby doth not prosecute the
Said Appeale prayed in the name of W^m Rogers and Mary his Wife Lately
called Mary Contee With Effect.
