42 MARYLAND COURT OF APPEALS

done in the prmises according to Law; whereof you are in no wise to fail:
Witness our Trusty and Wellbeloved Francis Nicholson Esq Capt Genll and
Govern1" in Cheif in and over our sd Province and Territory aforesd this 2 9th
day of March in the Ninth Year of our Reign etc: Annoque Domini 1697.

Thomas Tench Esq agt Wm Hopkins
in Appeal.

This Cause is Continued by Consent of both Parties.

At a Court before his Exncy the Governr and his Mats honrble Councill for
hearing Appeals and Writts of Error etc. Met and held at the Port of Annapo-
lis, According to Appointment by Proclamation etc: the 25th day of May in
the Ninth Year of the Reign of our Soveraign Lord King William the Third
etc: Annoque Domini 1697.

Present: His Exncy Francis Nicholson Esq Capt Genll etc; Sr Thomas Laurence
Baron1 Secryr; Coll: Nicho Greenberry; Thomas Tench Esq; Coll: Charles
Hutchins.

The Court Adjourns to the 3d day of June next.

At a Court for Appeals etc: according to Adjournment the 3d day of
June, Anno: Domini 1697.

Present: His Exncy Francis Nicholson Esq Capt Gen» etc; Sr Thomas Laurence
Baron' Secryr; Coll: Nicholas Greenberry; Thomas Tench Esq; [60] Coll:
Charles Hutchins; Colt: John Addison; Coll: John Courts; Thomas Brooke
Esq.

Mr Wm Sharpes Petition ab* his Supersedeas etc: Read and debated.

Mr Wm Sharp of Talbot County, having prsented his humble Petition to
this Honrble Court, setting forth that being in Custody of the Sherriff of Ann
Arrundell County (notwithstanding a Supersedeas issued) he was illegally
detain'd, therefore prayed Some Relief therein that he might be dismissed
etc: woh sd Petition being Referred to Mr Sollicitor Genll and his Report
thereon likewise produced, he is further asked what legall or proper Course
could be taken The Counsell for Mr Sharp being prsent do humbly Move
that they may be admitted and have time till to Morrow Morning to prepare
themselves to argue the sd Case, not doubting but that they Should (by good
authoritye) prove the illegality of his detainer, the woh was accordingly
Granted.

The Court Adjourns till to Morrow Morning.
