Appeals to be held at the City of Annapolis on the tenth day of October
Anno Dom 1722 to hear the Errors Assigned upon the Judgment aforesaid
if to him it Should Seem meet And the Same day is given to the Said Thomas
Gassaway also. On Which Said tenth day of October Anno Dom Seventeen
hundred and Twenty two before his Said Lordships high Court of Appeals
aforesd at the City of Annapolis aforesaid Comes as well the Said John
Gresham Daniel Dulany and Thomas Humphrys by their Attorney afa as the
Said Thomas Gassaway by Thomas Bordley his Attorney And the Sherriff afd
Did not Send the Writt [sic] And thereupon the Said John Gresham Daniel
Dulany and Thomas Humphrys by their Attorney aforesaid as the Said
Thomas Gassaway by Thomas Bordley his Attorney and the Sherriff aforesaid
did not Send the Writt [sic] And Thereupon the Said John Gresham Daniel
Dulany and Thomas Humphrys as before Say that in the Record and process
aforesaid as also in Rendering the Judgment it is manifestly Erred Alledging
the Errors aforesaid by them the Said John Gresham Daniel Dulany and
Thomas Humphrys in forme aforesaid above alledged and pray that the
Judgment aforesaid for the Errors aforesaid and others in the Record afore-
said being may be reversed Annulled and altogether held for None and that
they to all things Which by Occasion of the Judgment aforesaid have lost
May be restored and that the Said Thomas Gassaway to the Errors afore Said
Rejoine and that his Lordship's Court of appeals and Errors here will pro-
ceed to the Examination as well of the Record and process aforesaid as of the
Matters afd above for Errors Assigned And the Said Thomas Gassaway Saith
that neither in the Record and process aforesaid nor in the Matters therein
Contained nor in rendering the Judgment aforesaid it is in any wise Erred
and Likewise prays that his Said Lordships Court of Appeals and Errors here
proceed to the Examination as well of the Said Record and process aforesaid
as of the Matters aforesaid above for Errors Assigned and that the Same Judg-
ment in every thing may be Confirmed but because his Lordships Court of
Appeals and Errors here of rendering of their Judgment of and upon the
premisses are not as yet advised day is thereof given [606] to the parties afore-
said before his Lordships Governour and Council from the Said tenth day of
October Anno Dom Seventeen hundred and Twenty two at the City of An-
napolis aforesaid Untill the first Tuesday in May being the Seventh day of
the Same Month Anno Dom Seventeen hundred and Twenty three to hear
their Judgment of and upon the premisses for that his Lordships Court of
Appeals and Errors here thereof are not as yet advised. At Which Said first
Tuesday of May last Mentioned before his Lordships Governour and Coun-
cil afd Sitting at a Court of Appeals and Errors at the City aforesaid Comes
the parties afd by their Attorneys aforesaid. But because his Said Lordships
Said Court of Appeals and Errors now here of their Judgment aforesaid of
and upon the premisses to render are not as yet advised further day is given
as well to the Said John Gresham Daniel Dulany and Thomas Humphrys as
