Gassaway to before his Lordships Governour and Council at Annapolis to
hear the Record and process aforesaid and it is granted unto him Therefore
Command is given to the Sherriff of Annarundell County that he Should
Make known unto the Said Thomas Gassaway that he Should be and appear
in the Said High Court of Appeals to be held at the City of Annapolis on the
Tenth day of October Anno Domini Seventeen hundred and Twenty two to
hear the Errors Assigned upon the Judgment aforesaid if to him it Should
Seem meet and the Same day is given to the Said Thomas Gassaway also.

On which Said tenth day of October Anno Domini Seventeen hundred
and Twenty two before his Said Lordships high Court of Appeals aforesaid
at the City of Annapolis aforesaid Comes as well the Said John Gresham by
his Attorney aforesaid as the Said Thomas Gassaway by Thomas Bordley his
Attorney and the Sherriff aforesaid did not Send the writt and thereupon the
Said John Gresham as before Saith that in the Record and process aforesaid
as also in rendering the Judgment aforesaid it is manifestly Erred Alledging
the Errors aforesaid by him the Said John Gresham in forme afore Said
above Alledged and prays that the Judgment aforesaid for the Errors afore
Said and others in the Record and process aforesaid being may be Reversed
annulled and altogether held for None and that he to all things which by
Occasion of the Judgment aforesaid hath lost may be Restored and that the
Said Thomas Gassaway to the Errors aforesaid rejoine and that his Lordships
Court of Appeals and Errors here will proceed to the Examination as well of
the Record and process aforesaid as of the matters aforesaid above for
Errors Assigned and the Said Thomas Gassaway Saith that Neither in the
Record and process aforesaid nor in the Matters therein Contained nor in
rendering the Judgment aforesaid it is in anywise Erred and Likewise prays
that his Said Lordships Court of Appeals and Errors here proceed to the
Examination as well of the Record and process aforesaid as of the Matters
aforesaid above for Errors Assigned and that the Same Judgment in every-
thing May be Affirmed but because his Lordships Court of Appeals and
Errors here of rendering of their Judgment of and upon the premisses are
not as yet advised day is thereof given to the parties aforesaid before his
Lordships Governour and Council from the Said tenth day of October Anno
Domini Seventeen hundred and Twenty two at the City of Annapolis afore-
said Untill the first Tuesday in May being the Seventh day of the Same

IVfnnth Anno Domini Seventeen hundred and Twenty tluee CO hear their

Judgment of and upon the premisses for that his Lordships Court of Appeals
and Errors here thereof are not as yet advised. At which Said first Tuesday of
May last Mentioned before his Lordships Governour and Council aforesaid
Sitting at a Court of Appeals and Errors at the City [598] aforesaid Comes
the parties aforesaid by their Attorneys aforesaid but because his Said Lord-
ships Said Court of Appeals and Errors now here of their Judgment aforesaid
