Seventeen hundred and twenty one in his Lordships Provinciall Court of
Maryland before his Lordships Justices of the Provinciall Court at Annapo-
lis a [579] Certain Edmond Benson Impleaded a Certain Samuel Howard
late of Annarundell County Planter of a plea Wherefore with force and Arms
into one Dwelling house and three hundred and twenty Acres of plantable
Land called Warners neck near the River Severn Begining at a marked Oak
in a hollow near a Creek called Warners Creek and running West by the
Creek for the Length of two hundred Seventy five perches bounding on the
West with a Line drawn north from the End of the West line for the Length
of Ninety five perches to a marked Oak on the North with a line drawn East
by South into a Cove and with the Cove on the South East with the said
Creek and River Containing and laid out for three hundred and twenty
Acres lying in Annarundell County af^d which Henry Sewell to the said Ed-
mond demised for a term which is not yet past hath entered and him from his
farm af^d hath Ejected and other harms to him hath done to the great damage
of him the same Edmond and against the peace etc: Whereupon the same
Edmond by Thomas Bordley his Attorney Complains that whereas the af¹
Henry the first day of October in the year of our Lord God Seventeen hun-
dred and twenty at Annarundell County af^d did Demise unto the af^d Edmond
Benson the af^a house Land and Premisses with the Appurtenances to have
and to hold the same unto the said Edmond and his Assignes from the
twenty nineth day of September then last past un till the End and term of five
Years then next following and fully to be Compleat and Ended by Vertue
of which Demise the same Edmond into the af^a house and premisses with the
Appurtenances Entered and was thereof Possessed and the same Edmond
being so thereof possessed the af^d Samuel Afterwards to wit the same first day
of October Anno Domi: Seventeen hundred and twenty af^d with force and
arms etc: into the af^d house Land and premisses with the Appurtenances
which the same Henry to same Edmond in form af^d Demised for the term af"
which is not yet past Entered and him from his farm af^a Ejected and other
harms to him hath done to the great damage of him the said Edmond and
against the peace etc; Wherefore he says he is the Worse and hath lost to the
Value of two hundred pounds Sterling And therefore he brings this Suit
etc; And the af^d Samuel Howard in the same Court by Michael Howard then
appeared and then and there Defended the force and injury when etc: and
prayed leave to Imparle thereunto untill next Court and he had it and the
same day was Given to [580] the Plantiff alsoe at which said next Court to
witt the io^th day of October Anno Domi Seventeen hundred and twenty One
came again the said Parties plantiff and Def' by their Attorneys af^d and the
said Defendant by his said Attorney then pray'd further leave to Imparle
thereunto untill next Court and he had it and the same day was given to
the Pit: alsoe at which said next Court to Witt the io^th day of April Anno
Domi Seventeen hundred and twenty two came again the said parties pit:
