the same Gilbert hath not paid nor him for the same in any wise Contented
(altho so to do the af^d Jonathan afterwards to Witt the tenth day of October
Anno Domi Seventeen hundred and Nineteen af^d and often afterwards at
Annarundell County af^d by the Same Gilber hath been required) but the
Same to him hitherto to pay or him for the same in any wise to Content hath
altogether refused and Still doth refuse to the Damage of the said Gilbert
Seven hundred and fifty pounds Sterling and thereof he brings the Suit etc.

And the said Jonathan Forward by Daniel Dulany his Attorney Comes
and defends the force and injury when etc: and prays Leave to Imparle
hereunto untill next Court and he hath it and the same day is given to the
pit: also

At which said next Court to wit the 20^th day of September Anno Domi.
Seventeen hundred and twenty Come again as well the said Gilbert Powlson
by his Attorney af^d as the said Jonathan Forward by his Attorney af^d and the
Said Gilber Powlson by his Attorney af^d prays that the said Jonathan For-
ward to his Deci: in the plea af^d may Answer

[535] And therupon the said Jonathan Forward by his said Attorney as be-
fore defends the force and Injury when etc: and Says nothing in barr or
Avoyance of the Action af^d of the said plantiffs so as af^d against him brought
so that the said plantiff remaines against the said DeP altogether undefended

Wherefore the said Gilbert Powlson his damages which he has Sus-
tained by Occasion of the Premisses against him the said Jonathan Forward
Ought to recover but because it is unknown what damages the said Gilbert
Powlson has Sustained by Occasion of the premisses afs^d (and for that the
said Jonathan Forward by his Attorney afs^d being present in Court as af^d)
Comand is given the Sherriff of Annarundell County that he by the Oaths
of Good and lawfull men of his Bayliwick deligently Enquire what Damages
the said Gilbert Powlson has sustained by Occasion of the premisses af^d and
the Inquisition which thereof he Shall make that the said Sherriff make ap-
pear to his Lordships Justices here Imediately as well under his Seale as the
Seale of those by whom etc: he Send together with the Writt thereof to him
directed etc.

And now here this day to Witt the twentyth day of September Anno
1720 being the same day and year Comes the said Gilbert Powlson by his At-
torney af^d (and the Said Attorney of the said Jonathan Forward having had
Notice of the Execution of the Writt as af^d) the said Sherriff likewise Comes
and returns to the Court here his Inquisition taken before him at Annarun-
dell County the same day and year by the Oaths of Twelve etc, by which it
