332 MARYLAND COURT OF APPEALS

set forth by the Appellant but for better Certainty referrs himself to the
transcript of the Record [507] thereof now here in Court and this Respondt
further saith that the said Decree from which the said Appellant hath ap-
pealed is as this Respondt is advised Just and well warranted by the Rules
of Equity and therefore this Respondt hopes this most Honrbl house will
find no Cause to alter but will Confirm the same and this Respondt hum-
bly prays the said Petition of Appeale which doth not truely nor fully
state the fact as it appears by the Proofs shall be Dismist with Exemplary
Costs.

August the 1st 1721.

The foregoing Nathl Hynson make Oath that what is Contained in the
foregoing Answer as of his Own Knowledge is true and what is therein re-
lateing to the Act and Deed of another he believes to be true and what is
therein denyed is not true to the best of his knowledge.

Then Came NathH Hynson Nephew to the foregoing Respondt and Heir
at Law of John Hynson in the foregoing Answer mentioned and made Oath
on the Holy Evangilists that he Knows the most of the facts in the foregoing
Answer to be true, and that he believes the whole to be true.

At which said Seventeenth day of October Anno Domi Seventeen hun-
dred and twenty One before his said Ldships Court of Appeales at Annapolis
came the said John Ward by his Attorny afsd and likewise the afd NathH Hyn-
son by his Attrny afsa And because his said Ldships Coun of Appeales hereof
their Judgmt of and upon the Premisses to render is not yet advised day
thereupon is given to the said Parties Before his said Ldships Court of Ap-
peals from the said Seventeenth day of October untill the third day [508] of
November thereafter.

At which said third day of November Anno Domi Seventeen hundred
and twenty One afd Before his Ldships said Court of Appeales at Annapolis
Came the said John Ward by his Atfny afd as also the said Nath" Hynson by
his Attorney afd and because his Lordships said Court of Appeales hereof
their Judgmt of and upon the premisses to render is not yet advised day
thereupon is given to the said parties before his Ldships said Court of Ap-
peales from the said third day of November untill the third day of April
thereafter Anno Domi Seventeen hundred and twenty two.

At which said third day of April Anno Domi Seventeen hundred and
twenty two afd Before his said Ldships Court of Appeals at Annapolis Came
the said John Ward by his Atfny afd as also the said Nathll Hynson by his
Atfny afsd And thereupon Daniel Dulany the Attorney for the Appelt takes
