320 MARYLAND COURT OF APPEALS

Supplicant and daily Orator Nathaniel Hynson of Kent County Gent gaurd-
ian and next friend of Nathaniel Hynson the son of John Hynson late of
Cecill County Deced

That the said John Hynson in right of his Wife Mary the Daughter of
John Stoope was Seized in fee of five hundred Acres of Land called the worlds
End Originally surveyed for and Pattented in the name of one Francis Child
about the year Sixteen hundred Sixty five Butted and bounded according to
pattent as follows. Beginning at a marked Hiccory Tree standing by the
side of a bank by the River side near a valley and on the westermost side of
the said Valley running from the said Hiccory for breadth up the river four
hundred and thirty perches to a marked white Oake Standing on a bank by
a Creek called harbour Creek Crossing the said Creek by a line drawn North
East to a marked red Oake standing by a red bank twenty Perches running
from the said Oak up the river Easterly one hundred Perches to a marked
white Oake standing on a high bank by the westermost side of a small Cove
bounded on the said Oake by a line drawn North and by East for length into
the woods three hundred and twenty Perches bounded on the North and by
East by a line drawn West two hundred and fifty Perches bounded on the
West by a line drawn South and by West to the marked hiccory together with
the said River Containing and laid out for five hundred Acres more or less
which said five hundred Acres of Land is now become the right of the said
Nathll the son of the said John by deed duely executed and here in Court
ready to be produced from the said John and Mary to the said Nathaniel
Hynson that the said John Hynson made Improvements on the said Land
by building and Planting [489] fruit Trees thereon to a very Considerable
value that after the Decease of the said John Hynson a Certain John Ward
of Cecill County Gent: made Application to his Lordship the R* Honble the
Lord Proprys Agent for land affairs and by his humble Petition sett forth that
a Certain Jane Martinson late of the said County deced a forreigner being a
Sweed by Nation had on the twenty fourth day of September Sixteen hun-
dred Sixty one survey'd and laid out for her a parcell of Land lying in the
said County called Martinson for fifty Acres but letters Patents having never
issued thereon and the said Jane dying an Alien and without Issue the said
John Prayed the preemption of the Escheat thereof the same lying most Con-
venient to him of any Other Person and also that he being the first discoverer
thereof and that Patent might issue to him thereon which was allowed him
in Consideration of the premisses and of five pounds ten Shillings Sterling
by him paid to his Ldships Agent and thereupon and upon other false Sug-
gestions that the said fifty Acres of Land was not Cultivated and not im-
proved by any other Person the said John being a Man of figure in the said
County gained Credit with his Ldships Agent and Obtained A patent of
Escheat which Issued accordingly to the said John Ward that thereupon the
said John Ward brought an Ejectment in the Provinciall Court which is still
