24 MARYLAND COURT OF APPEALS

Eighty hogsheads of Tobacco did take and load on board the Said Ship Anne
riding in Potuxent River [31] before that he the Said John Blackmore had
given Bond with one Surety or produced Certificate according to the afore
Said Act of Parliamt whereby the Said John Blackmore hath forfeited his Said
Ship with all Guns Tackle Apparell and Furniture for his unlawfull load-
ing or taking on board the Said Ship the afore Said Tobacco against the
Forme of the Statute afore Said Whereupon the Said Edward Randolph who
as well for our Said Soveraign Lord and Lady as for himself prayeth the one
Moiety according to the Forme of the Statute and as well for our Said Sov-
eraign Lord and Lady as for himself prayeth the advice of the Court in the
premises And that the Said John Blackmore may Come here into Court to
answer.

And the Said John Blackmore by Robert Goldesborough his Attorney
cometh and Defendeth the Force and injury when etc: and for Plea saith
that he is not guilty in manner and Forme as in the Information afore Said
is Sett Forth and for Tryall putts himself upon the Countrey, And the Said
Edward Randolph who as well etc: also.

Command was therefore given to the Sherriffe of Ann Arrundell County
that he Cause to Come here Twelve etc: by whom etc: and who neither etc:
because as well etc: To Recognize etc:

Now here at this day to Witt the Three and Twentieth day of August
Annoque Domi 1695 Came the Said Parties by their Attorneys afsd and the
Jurors of that Jury being impannelled and Called Came likewise Vizt Philip
Lynes, John Rockhold, Charles Stevens, William Dare Abraham Childe
Alexander Kyele John Bronnick Edward Hall Alexander Dehenosia Michael
Jude Robert Kirkland and William Harpham who being Elected tryed and
Sworn to Speake the Truth of the Premises upon their Oathes doe Say, We
of the Jury doe find the Said John Blackmore Not Guilty in manner and
Form as afore Said.

Therefore it is Considered by the Justices here the Same day and Year
afore Said, That the Said Edward Randolph Esq who as well etc: take noth-
ing by the information afore Said, and that the Said John Blackmore go
thereof without day.

Whereupon the Said Edwd Randolph Esq who as well etc: by George
Plater his Attorney Craved an Appeale to his Exncy the Governr and Coun-
cill, and it is granted unto him etc:
