[29] Burgesses Ex* ag^t Michaell Miller

The Def^t upon his Writt of Error brought before this hon^rble Court for
removall of certain proceedings and Judgm^t obtain'd ag^t him by the Plan-
tiffe in the Provinciall Court humbly moves that he could not as yet obtain
the full Record but has procur'd his Ma^ts Writt of Diminution to Command
the Same therefore prays that the Cause may be continu'd till October Court,
and it is granted unto him accordingly, Provided he imediately file Errors
upon the Return of the Record and more Especially considering that it may
be time Enough for obtaining Tobacco in October but the Attorneys in
Generall are given in Charge to take Notice that this may not pass into a
President.

At a Court before his Ex^ncy the Govern^r and Councill for hearing Ap-
peales and Writts of Error held the 11^th day of October in the 7^th Year of his
Ma^ts Reign etc: Annoque Domi 1695.
