writeing bearing Date the Seventh Day of november anno Dni Sixteen hun-
dred Eighty five and Subscribed in the presence of four Wittnesses and to us
of the Jury in Evidence Given gav'd and bequeathed unto his Loveing wife
Aimc Gcnard all his Estate as well Reall and personall and Shortly atter
dyed, haveing and being possessed of a personall Estate Sufficient to pay and
Satisfye his Debts and upwards, after whose Death the Said Anne was Seized
of the Said Land in Dispute (by vertue of the Devise of the Said Thomas the
afd Justinian then liveing who afterwards dyed in the year Sixteen hundred
Eighty Seven without Issue.

Wee allso find that Sarah the wife of the Said Justinian Survived him
and Inter married with one michael [315] Curtice of St marys County, and
that the Said Anne the wife of the Said Thomas afterwards Intermarryed
with one John Bayne Gent, and had Issue by the Said Bayne (vizt) Elsworth
Bayne whome wee find to be heir at Law to the Said Anne.

Wee find further that the Said John Bayne and the Said Anne his Wife
in Right of the Said Anne by vertue of the Said devise continued in quiet and
peaceable possession of the Land in Dispute afsd dureing their naturall lives.

Wee further find that the Said John Bayne and Ann his wife both dyed
about the year Seventeen hundred and two and that after their Decease
(vizt) the Day of anno Doni Seventeen hundred and three John
Gerrard Son and heir of John Gerrard Brother to the afd Justinian and
Thomas Gerrard Entered into the Land and premises afsd claimeing the
Same as heir at Law to the Said Thomas the Devisor.

and the afd John Gerrard after his Entry afd continued in Quiet and
peacable possession of the Land afd dureing his naturall life.

That the Said John by his Last will and Testamt in writeing Subscribed
in the presence of three Wittnesses bearing Date the twenty ninth Day of
Janry anno Dni Seventeen hundred and ten and to us of the Jury in Evidence
Given gave and devised all the Said mannor of westwood (Except one hun-
dred Acres there of) unto his Loveing wife Jane Gerrard and to the heirs of
her Body Lawfully begotten or to be begotten and in [316] Default of Such
Heirs to his Brother James Johnson and his heirs for Ever and the Said one
hundred Acres Excepted as afd unto George Eskridge the Defendt and his
heirs for Ever.

and that the Said John Gerrard dyed afterwards (vizt) the tenth Day of
aprill anno Dni Seventeen hundred and Eleven after whose Decease the Said
michael Curtice and Sarah his Wife by their Deed Indented acknowledged
and Enrolled according to Law bearing Date the Eighteenth Day of may
anno Doni Seventeen hundred and Eleven for the Considerations therein
mentioned bargained Sold Conveyed Enfeoffed and Confirmed the Land in
Question to the lessor of the Plft and his heirs and assignes for Ever.
and that the Said Jane Gerrard the Relict and devisee of the Said John
Gerrard by her Deed of Demise Indented acknowledged and Enrolled ac-
