MARYLAND COURT OF APPEALS 177

Will and testament of Ann Lynes who was Executrix of the last Will and
Testament of Phillip Lynes Esqr deceasd as of their Complaint Wee have
receivd And wee being willing that the Error if any there be should be duely
corrected and full and Speedy Justice done in this behalfe Comand You that
if Judgment be thereof rendred then the record and process of the plea afore-
said with all things thereunto relating to our president and Councill of
Maryland at Annap[olis] on the twelfth day of May next under your hand
and seale distinctly and openly you send and this Writt that the record and
process aforesaid being Inspected our said President and Councill may fur-
ther cause to be done for the Correcting of that Error What of right and
According to law shalbe to be done Wittness our self at the City of Annapolis
aforesd this twentyeth day of Aprill in the twelfth Year of our reigne etc.

Which being read and heard is by the Justices here allowd and the
record therein mentiond orderd to be sent according to the tenour thereof

In Testimony whereof the Seale of the provinciall Court is hereunto
Affixed per John Beale Clr
[Loc Sigil Provs]

On Which said Twelfth day of May aforesaid Anno Domni 1713 before
her Majestys President of her Councill of Maryland and the same Councill
sitting in A Court for hearing Appeals and regulating Writts of Error At
the City of Annapolis came the Aforesaid Walter Storey and Michaell Martin
Executors of Ann Lynes who was Executr of Phillip Lynes deed as aforesaid
by Wornell Hunt their Attorney aforesaid and say that in the Record and
process aforesaid as also in the rendring of Judgment it is Manifestly Erred
Vizt.
[261] Errors Assignd. Vizt.

1th. There is no Originall.

2dly. It is Erred in this that it does not appear to which King Lynes
was Summoned to answer whether to the King that was King at the time
of the Suite brought or the King that was before the Suite brought or to
whom the bond was past

3dly. It is Erred in this that it is uncertain to what King he should
render or to what King he ow'd or unjustly detained

4thly. It is Erred in this that the debet and detinett etc. is left out

5thly. It is Erred in this that the declaration is uncertain insufficient and
wants forme.

6thly. It is Erred in this that is no recitall made that the said Lynes
was bound by bond.

7thly. It is Erred in this that it is sett forth Lynes by his bond dated
the Seaventh day of Aprill One thousand Six hundred Eighty Eight ac-
