Charles Greenberry Lessee of Joshua Merekin agt James Heath
[157] MARYLAND ss. James Heath late of Kent County Gentn was Attached
to answer unto Charles Greenberry Gentn of A plea wherefore he the said
James with force and Arms into one Dwelling House Two Tobaccoe Houses
and Six hundred Acres of land and pasture calld Scotland with the appur-
tenances in Ann Arundell County which Joshua Merekin of the Same
County planter for A terme of Years Yet to come and unexpired did enter
and him from his farme aforesaid did Eject and other harms to him did to
the Great damage of the said Cha[r]les and against the peace etc.
And Whereupon the said Charles by Will™ Dent his attorny complaineth
that whereas the said Joshua the Third day of Aprill in the Year of our
Lord One thousand Seaven hundred at Annapolis in Ann Arundell County
aforesaid did demise to the said Charles the lands and tenements with the
appurtenances called Scotland lying and being in Ann Arundell County near
unto A Creek called Fishing Creek beginning at A marked Pockicoryl stand-
ing near the head of A Swamp of A Creek calld Scotchers creek bounding
on the North by A line drawne East and by North from the said Pockicory
for the length of One hundred and twenty perches to a marked Oake And
with A line drawne Southeast from the said Oake for the length of One Hun-
dred and twenty perches to A marked Hiccory being and standing by A great
Marsh on the east with the land lately possess'd by Robert Short and with
the said Bay unto the said Fishing Creek on the South with the said Creek
and with the Land of Oliver Spry planter and on the West with the said
Creek called Scotchers Creek containing and layd out for Six hundred Acres
more or less To have and to hold the sd land and tenements with the appur-
tenances unto the said Charles Greenberry and his Assignes from the said
Third day of September for and during the full terme of five Years fully to be
compleat and ended by Virtue whereof the said Charles into the lands and
Tenements aforesaid did enter and was thereof possessed and being thereof
so possessed the said James Afterwards that is to say the fifth day of September
aforesaid at Ann Arundell County aforesaid into the Messuages lands and
premises aforesaid in form aforesaid demised for the terme aforesd Which is
not Yet passed entred and him from his farme aforesaid did Eject and other
harms to him did to the damage of the said Charles and Against the peace
etc. Whereupon the said Charls Saith that he is dampnified to the Value of
Twenty Thousand pounds of Tobaccoe And thereof he brings this Suite etc.
And the said James Heath by Jacob Regnier his attorney cometh and
defendeth the force and Injury when etc. and prayeth [158] liberty to Im-
parle thereunto untill next Court and it is granted unto him the same day
is given the plaintiff also, directed to Nathanl Ever[i]tt Gentn in possession
as well.
