HOG STEALING.
1. Persons killing any unmark'd
Swine, above Three
Months old, (not being upon their own Lands, or in
Company with their own Stock) shall be adjudged
Hog-Stealers, and suffer such Corporal Pains as in the
Case of Thieving and Stealing. 1715, ch. 26, §. 4.

2. Persons concealing or disfiguring the Marks
of
Swine so killed, by cutting off their Ears, &c. shall be
adjudged Hog Stealers. Ibid. §. 5.
3. Any Person convict of Thieving, Hog Stealing,
or other Crime, or that shall be of evil Fame, or a Vagrant,
or dissolute Liver, that shall shoot, kill, or
hunt, or be seen to carry a Gun upon any seated Plantation,
without the Owner's Leave, shall forfeit 1000 lb
Tobacco; one Half to his Majesty, the other Half
to the party grieved, or Person suing for the same.

HORSES.
1. All Inclosures by Fences or
otherwise (within
this Act) shall be Five Feet high. And from the 1st
May till the 10th November yearly, all Owners of Horses,
Mares, Colts, or Geldings, shall keep them within
good and sufficient Inclosures, fenced Grounds, or
Pastures, under the Penalties in this Act mentioned.

2. And if any such Horses, &c. shall break
into the
Pastures, Corn-fields, or other Inclosures, of any Inhabitants
of this Province, within the Time before
limited; if the Owner, after Notice thereof given
him two several Times by the Party grieved, shall
neglect to perform what is by this Law enjoined, such
Horses, &c. may be shot or destroyed by the Party
grieved. Ibid. §. 2.
3. But no injured Person may kill such Horses,
&c.
unless within his own proper inclosed Grounds, on
Penalty of paying the Owner the full Value of such
Horse, &c. so destroyed. Ibid. §. 3.
4. Persons unlawfully taking and keeping One Hour
in their Possession, or riding or working any other
Man's Horse, &c. without Knowledge or Consent of
the Owner (unless found Trespassing, and the Owner
not known) shall pay Damages to the Owner, and
also forfeit 500 lb Tobacco, one Half to the Informer,
the other Half to the Party grieved; to be recovered in
the County Court by Action of Debt, &c. Ibid. §.

5. Any Stoned-Horse that hath been broke, being
found loose and out of Inclosure, may be taken up
and impounded by any Person whatsoever, and there
detained till the Owner shall pay 5 s. or 60 lb Tobacco
to the Person impounding such Horse. Ibid. §. 11.
6. Stoned Colts above 18 Months old, or Stoned
Horses unbroke, being found loose in the Woods, or
out of Inclosure, may be shot or destroyed by any Person
whatsoever. And the Person sued for such Shooting,
&c. may plead the General Issue, &c. Ibid. §.

7. No Person, not having Lands of his own, nor
Renting a Plantation, shall keep any breeding Mare
in the Woods; on Penalty of 600 lb Tobacco for
every such Mare; one Half to the County Charge,

HORSE STEALERS.
Every Person who shall feloniously
Take or Steal
any Horse, Mare, Gelding or Colt, within this Province,
and all their Aiders, Abettors and Accessories,
either before or after the Fact; and all Persons who
shall buy, take or receive, any Stolen Horse, &c.
knowing the same to be stolen, shall, on Conviction,
Outlawry, or refusing to answer directly, or standing
Mute upon Arraignment, or peremptorily Challenging
above Twenty, suffer Death without Benefit of Clergy.
