CONVICTS.
2. The Master or chief Officer
of such Ship, shall
lodge such Testimonial with the County Clerk, under
Penalty of 5 l. for every Offence, to be applied as aforesaid:
And a Copy of such Testimonial under the
Clerk's Hand, shall be full Evidence. Ibid. §.

3. Every Person importing Servants into this Province
by Land or Water, shall make Oath (or Affirmation
if a Quaker) before the Naval Officer, " Whether,
to the best of his Knowledge, such Servants
" be under Sentence of Transportation; and if so,
" for what Offence, and the Term of Years they have
" to serve." Ibid. §. 7, and 1729, ch.

4. Persons importing Servants, and refusing to
take
such Oath, forfeit 100 l. Current Money: And the
Naval Officer neglecting to administer the same, forfeits
100 l. like Money, to be applied as aforesaid. 1728,
ch. 23, §. 8.
5. Persons Forswearing themselves, or falsely
Affirming
in the Premises, are liable to be prosecuted and
suffer as in Case of Perjury. Ibid. §. 9.
6. A Copy of such Oath, certified by the Naval
Officer, shall be good in Law, in any Dispute concerning
such Convict, as if given vivâ voce at the
Trial. Ibid. §. 10.
7. Any Provincial or County Magistrate, on Application
or Suspicion, may examine any of the Ship's
Crew, touching their Knowledge of Convicts; and
such Examination or Deposition shall be good in law
as if given vivâ voce . Ibid. §. 11.
8. In all Criminal Prosecutions against any Convicts,
imported as such into this Province, the Testimony,
upon Oath, of any other Convicts, imported as such,
shall be received and allowed, such Conviction or Disability
notwithstanding.
9. But any such Convict, sworn as a Witness in
such Case, who shall swear falsely, shall suffer as in
Case of wilful and corrupt Perjury. Ibid. §. 3.

COUNTIES.
1. Anne-Arundel County erected,
1650, , ch. 8.
2. The Bounds of St. Mary's and Charles
Counties,
and between Talbot and Kent Counties, are settled, and
a new County erected by the Name of Prince-George's,
1695, ch. 13. And the same Divisions are confirmed.
1704, ch. 92, §. 1, 2.
3. The Bounds and Limits of Anne-Arundel and
Baltimore Counties, are settled by the Act of 1698, ch.
13. But so far of that Act as relates to the South Side
of Patapsco River, being added to Baltimore County, is
repealed by 1726, ch. 1.
4. Every County lying on any navigable River,
shall
extend its Jurisdiction from the Shore to the Channel
of the River, and be divided from the other County by
the said Channel. And where any Ship shall ride at
Anchor in such Channel, Process may be served on
board by the Officer of either County; but if Moored
by any Hold on the Land, she shall be deemed to lie |

5. The Bounds of Talbot, Kent, and Cæcil

COUNTRY BOTTOMS;
1. ----Are exempted from Payment
of Port-Duties
or Anchorage. See Port-Duties.
2. No Duties imposed by this Act, shall be
payable for
Servants, Negroes or Liquors, imported in any Ship
or Vessel built in this Province, whose Owners are all
actual Residents; nor in any Vessel, English or Plantation
built, purchased and enjoyed by Owners who
are all actual Residents, &c. Provided such Servants,
Negroes or Liquors, are imported in such Vessels into
the Capes of Chesapeak Bay, or some of the Inlets on
the Sea-board Side of Somerset County, and not taken
on board in the said Bay, &c. or from on board any
other Vessel within Ten Leagues of the Capes. 1715,
ch. 36, §. 17.
3. For preventing Abuses practiced under Sanction
of the preceding Article, Resident Owners of every
Ship or Vessel, shall, at the Time of Entry, or before
Clearance, take an Oath before the Naval Officer of
the District where she shall load or unload, that they
are the true and only Owners, &c. (See the Act for the
Form.) And Resident Owners refusing to comply
herewith, shall have no Benefit, but stand on the same
Foot with Non-Residents. 1720, ch. 26, §. 2 and 4.
4. In Case of any Resident Owner's being beyond
Seas about his reasonable Affairs, not exceeding 12
Months; his Oath during such Absence, may be dispensed
with; the other Owners Residents (if any be)
taking the same Oath. Ibid. §. 3.
5. For preventing the Inconveniencies which Resident
Owners may be put to, in entering their Vessels,
who live remote from any Naval Officer, an Oath
made by the Owners of any Vessel, before a Magistrate
in the County where such Owners reside, agreeable
to the Form prescribed in 1720, ch. 26, and a Certificate
thereof under Hand and Seal of the Magistrate,
shall be as effectual, as if taken before the Naval Officer
of the Port where such Vessel shall be entered:
Provided such Certificate be delivered to the Naval Officer
some Time before Clearing the Vessel. 1731, ch.
18, §. 1, 2, 3.
6. Owners of Vessels residing in different Counties,
may make more separate Oaths before a single Magistrate
(See the Act for the Form:) And on producing Certificate
thereof, under Hand and Seal of the Magistrate
before whom taken, to the Naval Officer, before clearing
the Vessel, shall have the same Privileges and Advantages,
as if they had taken Oath before the Naval
Officer. Ibid. §. 4.
7. The Additional Duty of 20 s. Currency
per Poll
on all Irish Servants being Papists, and on all Negroes
imported; appropriated by the Act of 1717, ch. 10, to
the Encouragement of County Schools, is declared to
be payable for all such Servants and Negroes imported
in Country Bottoms. 1728, ch. 8, §. 4, 5.
