N.B. This Act (which made it
Felony of Death, together with forfeiture of Lands, Goods,
&c. for any Apprentice Servant to depart away secretly
from his or her Master or Dame, with
Intent to convey him or herself away out of the Province;
and in any other Person that should
wittingly accompany such Servant in such unlawful Departure;
unless his Lordship, or his Lieut.
General, should think proper to change such Pains of
Death into a Servitude not exceeding
Seven Years, &c.) was superseded by the Act of 1649,
ch. 5, which last was repealed by 1676,
ch. 2. |

The above LAWS were published, under the Great Seal,
the 26th March 1642.

At a GENERAL ASSEMBLY, begun and held at
St. Mary's on the 18th Day of July
1642, in the
11th Year of the Dominion of the Right Honourable
CÆCILIUS, absolute Lord and Proprietary
of
the Provinces of Maryland and Avalon,
Lord Baron
of Baltimore, and ended the 1st Day of
August following.
Enacted by the lord proprietary, with the Consent of
the Freemen, as followeth. |

Any Ten Members of the House, at any Time assembled, at the usual
or appointed
Time (whereof the Lieutenant-General and Six
Burgesses to be Seven) shall be
a house, unless Sickness do hinder that Number:
In which case only the Members
present to make the House, Lib. C and WH.

N.B. The above Act first appeared
as an Order of the House of the 19th July 1642; but upon
Motion of the Secretary, intimating the Necessity of
it's passing by way of Bill, it was Read
as a Bill, and passed by all the Freemen, and then Enacted
by the Lieut. General, in his Lordship's
Name, for a Law. And, on the Day following, viz.
the 20th
July, 1642, it was again
read, and two Clauses were added, (1.) The
Repeal of all former Acts touching the House of
Assembly: And (2.) The limiting of
this Act to endure 'til the End of the next Assembly:
Which being accepted, it was accordingly that same Day,
published under the Great Seal. |

N.B. By this Act (1.)
Right and just, in all Civil Causes, to be determined according to
the law, or most general Usage of the Province since
it's plantation, or former Precedents of the
same or the like Nature. (2.) In defect of
such Law, Usage or Precedent, then according to
Equity and good Conscience, not neglecting (so far as
the Judges shall be informed thereof, and
shall find no inconvenience in the Application to this
Province) the Rules by which Right and
just useth and ought to be determined in England,
in the same or the like Cases. (3.) All Crimes
and Offences to be judged according to the Law of the
Province: Or, in defect of certain Law,
according to the Judges best Discretion, judging as near
as conveniently may be to the laudable
Law or usage of England in the same or the like
Offences. (4.) But no Person to be adjudged
of Life, Member, or Free-hold, without Law certain of
the Province.
