1704.
hereby impowered to administer the said Oath,  And in case the said Master
shall refuse the said Oath, or upon Suspicion of having Goods on board for
which he hath not Cleared, it shall be lawful for the said Naval Officer to enter
on board any such Ship or Vessel, and the same to search for any such
Goods as aforesaid; any thing in this Act before mentioned notwithstanding,
                                        Examined and Compared with the Original Act,  REVERDY GHISELIN,
                                                                                                                                      THOMAS BACON.

    N.B.  The above Act (which has been carefully compared with the Original) is the same,
mutatis mutandis, with that of 4 W. and M. 1692, ch. 4, excepting that in §. 3, the Words
[For the Support of her Government, for the Time being] are in the former Act [For the Support of
their Governor for the Time being.]  And in §. 3, of this Act, there appears a manifest Chasm
or Omission, owing to the Negligence of the Ingrosser or Transcriber of the Bill, and inattention
of the Assembly; the Passage in the Act of 1692 standing thus, [The said Duty, &c. shall
be, &c. paid, &c. by the Masters or Master of every such Ship, &c. upon his or their Clearing, and taking
out his or their Dispatch or Dispatches, for every such respective Ship or Vessel, and before the Departure
of such Ship or Vessel
from this Province.  And that every Master of such Ship or Vessel; coming
into this Province, shall, at their first Arrival here, and before their Loading on board and Goods, &c.
give good and sufficient Security to his Excellency, &c.

    A new law was made 1729, ch. 17, whereby this Act of 1704 was Repealed:  But the said
Act of 1729, being repealed by the Act of 1735, ch. 12 (and consequently the repealing Clause
therein,) the present Act emerges in its full Force and Virtue.

FORASMUCH as the Offences of Forestalling, Ingrossing and Regrating,
are found mischievous and prejudicial to the Inhabitants of this
Province; Be it Enacted by the Queen's most excellent Majesty, by and 
with the Advice and Consent of her Majesty's Governor, Council, and Assembly of
this Province, and the Authority of the same,
That whatsoever Person or Persons,
that from and after the Publication hereof, shall ingross, or get into his,
her or their Hands, or Possession, by buying, contracting, or Promise-taking,
within this Province, any Goods, or Merchandizes whatsoever, or Servants,
to the Intent to sell the same again within the Space of Six Months, and the
same, or any Part thereof, shall, within that Time, sell again for Ready Tobacco,
or for Tobacco to be paid the Shipping happening at the Time of
Preamble.
