It was adopted.
On motion of Mr. Mackubin,
The Convention resolved itself into a Committee of the
whole to consider, and report upon the Report of the Com-
mittee upon Public Works and Corporations, title, Article —
Public Works.
Mr. Dent in the Chair.
After some time spent in Committee of the Whole, the
Committee rose.
(The President resumed the Chair.)
And through Mr. Dent, Chairman, reported that they
have had under consideration the Report of the Committee
upon Public Works and Corporations, title, Article—Public
Works, had made some progress therein, and recommended
that the various proposed amendments to Section 3, which
had been read before the Committee lor information, he
entered on the Journal, and ask to be discharged from the
further consideration of the subject.
The Report was received, the recommendation concurred
in, and the Committee discharged.
The following are the amendments proposed to be sub-
mitted as substitutes for Section 3, and ordered to be entered
on the Journal.

Sec. 3. For the purpose of prosecuting efficiently the working
of the Chesapeake and Ohio Canal—of preventing any partizan
or political management thereof, and for the further purpose
of so regulating the tolls as will produce a fair and just re-
muneration to the Chesapeake and Ohio Canal Company—-
the following persons he, and are hereby appointed Commis-
sioners to serve without compensation, except for traveling
expenses, viz : who,
and their successors, to be selected as hereinafter mentioned,
or a majority of whom or of their successors, shall he author-
ized and empowered, until the first Monday in June, 1873.
to cast the vote of the State of Maryland as a Stockholder in
the Chesapeake and Ohio Canal Company at all meetings of
the Stockholders of said company; and that all vacancies in
the said Commissioners from refusal to act, death, resigna-
tion or other cause, shall he filled by such of the Commis-
sioners as may act, by and with the approbation of the Board
of Public Works; and in case all the said Commissioners
shall fail or refuse to act or to fill any vacancy or vacancies
among the said Commissioners, then the said Board of Pub-
lic Works shall appoint the said Commissioners or so many
of them as may be necessary to have five Commissioners as
