Board sets forth, that he hath for several years past been licensed
by the Court of said County to keep a Ferry over South River; that
his Endeavours to give Satisfaction have been unremitted, but that
upon the Evidence of Reuben McDaniel who deposed that his Boats
were on a certain Day absent from the Ferry until 10 o'clock in the
Morning, his Recognizance for fifty pounds was at the Court of the
aforesaid County for March Term 1786 declared forfeited. The
Petitioner alledges that on the Morning on which his Boats were
said by McDaniel to be absent from their Station he was from Home,
and that if they were really out of the way it was only a small distance
in quest of Wood, and that they never leave the Ferry but for that
purpose. The Petitioner states that the Sum forfeited is more than
his Annual Profit and prays a Remission thereof.
Whereupon the Board taking into Consideration the Circum-
stances set forth by the Petitioner and a State of his Case by the
Court, which corresponds with his Representation, as also a Recom-
mendation in his favor subscribed by four of the Justices of the
County aforesaid, are of Opinion that the forfeiture incurred is much
more than adequate to the Offence, and do therefore Order and
direct that the Sum of Forty seven pounds thereof be remitted.
