hundred Sixty one pounds of Tobacco, wch hee saith in his plea hee
hath paid him, and soe was not in issue before ye Jury and therefore
the said Judgment ought to bee arrested
Wch being read and heard Itt Seemeth to the Justices here that the
reasons aforesaid are insufficient in Law to arrest Judgment upon
the Verdict of the Jurors aforesaid, Therefore Itt is Considered
that the said John England take nothing by his writt but bee in
Mercy for his false Claime thereon, and that the said Gerrard slye
may goe from thence without day, and that the said Gerrard slye
Doe Recover against the said John England the sume of Twelve
hundred & sixteene pounds of Tobacco for his Costs & charges by
him about his defence in this behalfe Layd out & Expended, & the
sd Gerard may have thereof Execucon

to Answere unto Thomas Jones of a plea of Tres-
passe of the case

And Whereupon the said Thomas Jones by Rob-
ert Carvile his Attorney sayth that Whereas the said Thomas Jones
was in the yeares of our Lord god 1676 & 1677 Agent ffactor and
Attorney for him the said John England in this Province, Hee the
said Thomas did in the same yeares pay and disburse ffor him the said
John England to Severall psons hereafter named the seaverall sumes
hereafter menconed (that is to say) To Andrew Whittington Three
hundred pounds of Tobacco, To Edmund Lindsey One hundred
forty foure pounds of Tobacco to Major Breereton ffoure hundred
thirty nine pounds of Tobacco, To Mr Kenelm Cheseldyn Eight
hundred pounds of Tobacco, To the same Mr Cheseldyn Twelve
hundred Seaventy foure pounds of Tobacco, To Mr Randall Hanson
One hundred and Twelve pounds of Tobacco, To the said Mr Chesel-
dyn more the sume of Eight hundred pounds of Tobacco, To
Mr Edmund Beauchampe ffoure hundred pounds of Tobacco, To
William Watts six hundred Seaventy five pounds of Tobacco, and
the said Thomas Jones did in the same yeares Receive for him the
said John England the sume of Nine thousand seaven hundred
and one pounds of Tobacco for wch the said Thomas Jones was by
agreement to have and Receive for his sallary after the rate of ffour-
teene pounds p Cent wch comes to the sume of Thirteene hundred
fifty eight pounds of Tobacco, And the said Thomas Jones did Ex-
pend & was att the charges of One Thousand pounds of Tobacco in
makeing seaverall voyages Up the bay and up Potomack River about
the occasions of the said John England, and did also pay for the
said John England to Major Breereton by a bill of one popes due
to the said Thomas Jones and delivered to the sd Major Breereton for
to Receive of him the said Pope the sume of ffive hundred pounds of
Tobacco, All wch said sumes due in the whole amount unto the Sume
