284 Provincial Court Proceedings, 1679/80.

Novr 9th 1680
Now here at this day to witt the thirtyeth day of Novembr in the
fifth yeare of the dominion of the Rt honoble Charles Lord Balte-
more &c Annoq Dom 1680. the said accon being solemnly called
& noe pson appeareing to defend ye prmisses
Whereupon the said ffrancis Billingsley by George Parker his
Attorney aforesaid in the behalfe of the Lessor James Pascall prayed
that Judgmt might bee Awarded by default & also his Lopps writt to
Cause him to have posession of the prmisses. And It is granted unto
him accordingly

George Godfrey late of Charles County was at-
tached to answer unto John Lemarre of a plea
of Trespas


And Whereupon the said John by Robert Car-
vile his Attorney sayeth that Whereas the said George Upon the
Twentyeth day of November in the yeare of our Lord 1679 Att
Portobacco Creeke in Charles County in the said Province with
force & Armes the Close of him the said John did breake & three
Trees then and there growing of his the said John Did fell Cutt
downe & Carry away to the Vallue of fifteen hundred pounds of
Tobacco, & other harmes to him did to the Damage of the said John
& against the Peace Whereupon hee sayth he is damnifyed & hath
Losse to the Vallue of three thousand pounds of Tobacco & there-
upon hee bringeth his suite
And the said George Godfrey by Robert Ridgely his Attorney
Cometh & defendeth the force and Injury when &c and prayeth lib-
erty to imparle hereunto untill next Provll Court & It is granted
unto him the same day is given to the plt also :

Att wch said next Provinciall Court Came the said partyes by their
Attorneys aforesaid & the said George George Godfrey by his said
Attorney sayth that of the Trespasse above by the plt Imposed upon
him hee is in nothing thereof guilty in Manner and forme as the
said plt above against him hath Complained and of this hee puts
himself Upon ye Country
Whereupon this Court pceiveing it Very Necessary the better
to find out by whome the Trespasse aforesaid is Committed, that
the plantiffes Land be Surveyed and Laid out by some Skilfull
pson according to the Meets & bounds Menconed in the Pattent &
that a faire Plott and Certifficate thereof bee returned unto the Next
Provinciall Court Did thereupon Order that Randolph Brandt,
Gentt bee and is Especially appointed Impowered & Comanded to
Lay out the aford pcell of Land of the aforesaid John Lemarre
Lyeing on the West side of Se Thomas's Creeeke in Charles County
aforesaid according to the ancient meets & bounds thereof in the
prsence of William Chandler Sheriffe of the County aforesaid Who
