And in the same cause itt was ordered by the con-
tent of George Parker Attorney for the plt and
Robert Carvile Attorney for Robert Peca, that the

said Robert Peca should be admitted Defendt And
that he forthwith appeare & receive a declaracon & plead to itt the
generall issue, & att the tryall to be thereupon had, the said Robert
Peca shall appeare in his proper persons or by his Attorney, & shall
confesse Lease entry & Ejectmt or that in default thereof, judgmt
shall be entred against the Deft George Curwyn the casuall Ejector
But all further prosecution against him shall cease untill the said
Robert Peca shall make default in any of the prmisses And itt is
further ordered by the Court by the consent aforesaid, that the said
Robert Peca shall not take any advantage against the plt for not
prosecuting upon the tryall occasioned by such default, but that the
said Robert Peca shall pay to the plt the costs by this Court to be
taxed in this cause And itt is further ordered, that the Lessor to the
pft shall be charged with the paymt of the costs to the Defendt if any
adjudged to him

Comand was given to the Sheriffe of St Maryes
County, that by good & lawfull men of his baily-
wick he make known unto Henry Exon Admr
of the Goods & Chattles of John Garnis deceased,
that he be & appear e here the tenth dav of ffebry

in the fifth yeare of the Dominion of Charles Lord Baltemore &c
Annoq Doni 1679 to shew cause if any he have, why execution
should not issue forth against the Estate of the said John Garnis
upon a judgmt obtained against him by Samuell Allen Merchant
the sixth day of June last past for Tenn thousand three hundred
sixty nine pounds of tobacco debt And five hundred sixty foure
pounds of tobacco costs of suite, of which writt aforesaid although
no returne was made Neverthelesse the aforesaid Henry Exon came
by Robert Ridgely his Attorney And the said Samuell Allen by
Charles Boteler his Attorney prayeth his Execution against the
Estate of the said John Garnis of this debt & costs aforesaid And
the said Henry to preclude the said Samuell from his said Execution,
saith nothing. Therefore itt is considered by the Court here this
day to witt the Nineteenth day of ffebruary in the yeare aforesaid,
that the said Samuell Allen shall have his Execution, against the
Estate of the said John Garnis of the said debt of tenn thousand
direc huudicd sLx.ly nine pounds of tobacco And five hundred sixty
foure pounds of tobacco costs of suite And also that the said Sam-
uell Allen recover against the said Henry Exon Admr as aforesaid
the Sume of pounds of tobacco costs of suite
sithence laid out and expended
