cuted And the said Thomas Clarke may goe thereof without day
And that the said Thomas Clarke recover against the said John
Aylward the sume of Eight hundred fifty nue pounds of tobacco
for his costs & charges by him about his defence in this behalfe

sustaincd, to the said Thomas Clarke by the discretion of the Jus-
tices here adjudged And the said Thomas may have thereof Execucon

Clement Hill

George Oldfield late of Cecil County otherwise
called George Oldfield of Cecil County gentt was
Sumoned to Answer unto Clement Hill of a plea
that he render unto him the sume two Thousand

pounds of tobacco which to him he oweth & unjustly detaineth

And whereupon the said Clement Hill by Robert Carvile his
Attorney saith, that whereas the said George Oldfield upon the
twenty seventh day of May in the yeare of our Lord One thousand
six hundred seventy six by his bill or certaine writing obligatory
sealed with the Seale of him the said George here in Court pro-
duced whose date is the day & yeare above written, did confesse
himselfe to owe & stand firmly indebted unto the said Clement in
the full quantity of two Thousand pounds of good sound Mrchantable
leafe tobacco in cask to be paid to the said Clement Hill or to his
certaine Attorney his heyres Execrs Admrs or assignes conveniently
in Cecil County aforesaid att or before the tenth day of October next
ensueing Yet notwithstanding the said George the said Sume of
two thousand pcis of tobacco to him the said Clement though often
requested thereunto hath not paid, but the same to pay & satisfie
hath hitherto denyed & still doth deny & refuse to pay or satisfie the
same to the damage of the said Clement three thousand pounds of
tobacco & thereupon he bringeth his suite

And the said George Oldfield by Robert Ridgely his Attorney
cometh & defendeth the force & injury when &c and prayeth liberty
to imparle hereunto untill next Provinciall Court & itt is granted
unto him, the same day is given to the plaintiffe also

Now here att this day to witt the thirteenth day of March in the
fourth yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni 1678. cometh the said Clement Hill by his Attorney aforesaid
& offereth himselfe against the said George Oldfield in the plea afore-
said, but the said George cometh not but maketh default Therefore
itt is considered by the Court here that the said Clement Hill recover
against the said George Oldfield the aforesaid Sume of two thou-
sand pounds of tobacco debt As also
pounds of tobacco cost of suite And the said George in mercy &c
