place in Talbot County aforesaid within one Mile of some convenient
landing place in full & cleere discharge of one obligacon of the penall
sume of Thirteen Thousand three hundred forty & foure pounds of
good sound & every way well condiconed Mrchantable tobacco in
cask wherein the said Peter Sayer & John Brooke stand jointly &
severally bound together with the said Jno Quigley for the true paymt
of six thousand nine hundred Twenty & two pounds to James Stavely
Mrchant upon the twentieth day of October now next ensueing the
date hereof without any fraud or further delay That then this Obli-
gacon shall be void & of none effect, otherwise to stand & remaine
in full force strength & Vertue Which words being read & heard
the said John Quigley by his Attorney aforesaid prayeth liberty to
imparle hereunto untill next Provincl Court & itt is granted unto him,
the same day is given to the plaintifs also
Now here att this day to witt the ffifteenth day of October in
the third yeare of the Dominion of Charles Lord Baltemore &c
Annoq Doni 1678 cometh as well the said plaintiffes as the said
Defendt by their Attorneys aforesaid And the said Defendt saith
nothing in barre or avoidance of the action aforesaid of the said
Peter Sayer & John Brooke Whereby the said Peter & John remaine
against the said John Quigley thereof wholy undefended Therefore
itt is considered by the Court here that the said Peter Sayer & John
Brooke recover against the said John Quigley as well the sume of
Twenty six thousand six hundred Eighty & Eight pounds of tobacco
debt As also ffive hundred twenty foure pounds of tobacco costs of
suite So that Execution thereof cease untill next Provinciall Court
And the said John Quigley in mercy
