for divers yeares last past hath kept a Sloop of his own with two
men & himselfe in her to hire out to any person that would imploy
him & his said Sloop & men for the fetching carrying & transporting
of any goods or Mrchandizes from one place to another in this
Province And whereas the said James the first day of May One thou-
sand Six hundred Seventy seven att St Maryes in the said Province
in consideracon that the said Thomas with his said Sloop & men
would serve the said James in fetching down horses or other Goods
from Baltemore or Cecil County in the said Province & the same
deliver in St Maryes River, the said James did assume upon him-
selfe & to the said Thomas then & there faithfully promise, that for
every turn the said Thomas should make with his said sloop & men,
the said James would not only finde sufficient provision for the said
Thomas & the said two men in the said Sloop, but also would pay
unto him Thirteen hundred pounds of tobacco a turn as aforesaid
And further if the said Thomas with his said Sloop when he should
come and arrive in Baltemore County aforesaid should stay for his
loading above foure dayes after their Arrivall there & giveing the
said James due notice thereof, then for every day longer that the
Sloop should stay there more then foure dayes for want of their
loading aforesaid, the said James would pay unto the said Thomas
for every dayes demurrage of the said Sloop & men what should be
reasonable And the said Thomas in fact saith, that trusting to the
faithful promise & assumpcon of the said James to him the said
Thomas so as aforesaid made, he the said Thomas the second day
of May in the yeare aforesaid with his said Sloop & men did sayle
up from St Maryes River aforesaid, unto Baltemore County afore-
said, & there arrived with his said Sloop, & gave notice thereof to the
said James the Eighth day of the same May & there stayed for his
loading untill the twenty fourth day of the same May then next fol-
lowing which was twelve dayes demurrage over & above the said
foure dayes so concluded to be allowed him as aforesaid And further
saith, that the said Thomas between the first day of June then next
following & the twenty Eighth day of the same June did with his
Sloop & men make one Voyage or turn more for the said James
Mills in which tyme the said Sloop & men lay after notice given to
the said James of their Arrivall as aforesaid above the said foure
dayes so concluded to be allowed as aforesaid twelve dayes more
that is to say from the Eighth day of June aforesaid to the twentieth
day of the same June And the said Thomas further saith, that be-
tween the Eighth day of August then next following & the twenty
fourth of the same, the said Thomas & his Sloop & men did make
one Voyage or turn more for the said James, in which tyme the
said Sloop & men lay after notice giuen to the said James of their
Arrivall as aforesaid above the said foure dayes so concluded to be
