which will be in the yeare One thousand six hundred seventy & seven
Then this Obligacon to bee void & of none effect Or else to stand in
full force & vertue Which being read & heard the said Wm Hemsley
by his Attorney aforesaid prayeth liberty to imparle hereunto untill
next Provinciall Court & itt is granted unto him The same day is
given to the plaintiffe also.

Now here att this day to witt the Sixteenth day of October In
the third yeare of the Dominion of Charles Lord Baltemore &c
Annoq Doni 1678 came as well the said plaintiffe as the said
Defendt by their Attorneys aforesaid And the said Wm Hemsley by
his said Attorney saith, that he is not informed by the said Wm of
any Answer for the said Wm to the aforesaid. James Wasse in the
plea aforesaid to be given, & saith nothing else thereupon, by which
the said James Wasse remaineth against the aforesaid Wm Hemsley
thereof undefended Therefore itt is considered by the Court here,
that the said James Wasse recover against the said Wm Hemsley
as well the sume of Seven thousand pounds of tobacco debt As also
ffive hundred Sixty Eight pounds of tobacco costs of suite And the
said Wm Hemsley in mercy &c

of the Goods & Chattels of Nathaniel Stiles
in an action of the case

And whereupon the said Henry Stocket
& James Stavely by George Parker their Attorney complaine, that
whereas the said Samuel Boston the Seventeenth day of June One
thousand six hundred seventy & six stood indebted to the said Na-
thaniel Stiles the full & just quantity of Seven thousand foure hun-
dred & thirty pounds of large & bright tobacco cleare of ground
leaves & trash with cask to containe the same, to be well & truely
paid unto the said Nathaniel Stiles his heyres Execrs Admrs or as-
signes att or upon the twelfth day of Octobr next ensueing the day
above written Notwithstanding which the said Samuel Boston the
said Sume of Seven thousand foure hundred & thirty pounds of
tobacco although often thereunto required in his life tyme did not
pay nor the said James Mills since his death to whom Letters Testa-
mentory of the Goods & Chattels of the said Samuel Boston was
comitted to the said Nathaniel Stiles in his lifetyme did not pay
nor to the said Henry Stocket & James Stavely or either of them to
whom letters of Administracon of the Goods & Chattels of the said
Nathaniel was granted since his death although often demanded hath
not paid, but the same to pay hath denyed & refused & as yet doth
deny & [refus]e whereupon the said Henry & James say they are
the worse & have damages to the Value of twelve thousand pounds
