Edward Mann late of Talbot County otherwise
called Edward Man of Talbot County in the Prov-
ince of Maryland planter was Sumoned to Answer
unto Thomas Sprigg of a plea that he render unto

him ffoure thousand pounds of tobacco in cask which to him he
oweth & unjustly detaineth
And whereupon the said Thomas Sprigg by Charles Boteler his
Attorney complaineth, that whereas the said Edward Man upon the
twenty fourth day of October Annoq Doni One thousand six hun-
dred Seventy seven, by his certaine writeing Obligatory Sealed with
the Seale of him the said Edward & here in Court produced whose
date is the day & yeare aforesaid, did acknowledge himselfe to be
indebted unto Mr Thomas Sprigg of Petuxent of the said Province
ffoure thousand pounds of tobacco in cask in some convenient place
for Shipping in Tredaven att or before the twentieth day of Janu-
ary next ensueing the date hereof To wch paymt the said Edward
Mann did thereby oblige himselfe his heyres Execrs & assignes to
make good paymt accordingly being for two Mulattoes received of
him between five & six yeares old or thereabouts But in case the said
Man doe deliver to Mr Sprigg one man & one woman Servant or
two men Servants of the age of about Sixteen or Eighteen yeares
between this and the abovesaid tyme Then that prsent Obligacon to
be void & of none Effect, otherwise to stand in full force & Vertue
Notwithstanding which the said Edward though often thereunto
required one man Servant & one woman Servant nor two men
Servants of the age of about Sixteen or Eighteen yeares old unto
the said Thomas Sprigg hath not paid nor delivered Whereupon
action accrueth unto him to have & recover of the said Edward Man
the Sume of ffoure thousand pounds of tobacco according to the
tenour forme & Effect of the said writeing And the said Thomas
further saith that for want of the Servants aforesaid he is damnified
