Unlesse the Defendts appearce next Court, the Sheriffe of St Maryes County amerced

Comand was given to the Sheriffe of St Maryes County, that whereas att a Provinciall Court held att the City of St Maryes before the Jus- tices of the said Court the Eighteenth day of June last past, in a suite depending between

Walter Hall plaintiffe & Garret Van Sweringen Defend^t the said
Walter recovered judgm^t against the said Garret for fourteen thou-
sand pounds of tobacco debt with five hundred fifty & eight pounds
of tobacco costs of suite whereof he is convicted, whereof satisfac-
tion remaineth to be made Itt was therefore comanded the same
Sheriffe, that by good & lawfull men of his bailywick he make
known to the said Garret Van Sweringen that he be & appeare here
the fourth day of March in the third yeare of his Lordpps Dominion
&c Annoq Doni 1678. to show cause if any he have why Execution
should not issue forth upon the judgm^t aforesaid which said fourth
day of March on which the said Court ought to have bin held was
by his Lordpps writt of Adjournm^t Adjourned untill the fifth day
of March then next following, And from the said fifth day of March
was by his Lordpps writt of Adjournment Adjourned untill the
sixth day of March then next comeing On which said sixth day of
March the same Sheriffe maketh returne of the writt aforesaid That
by good & lawfull men of his bailywick he hath made known to the
said Garret Van Sweringen to be & appeare as by the same writt he
was comanded

Afterwards to witt the Eleventh day of March in the fourth yeare
of the dominion of Charles Lord Baltemore &c Annoq Doni 1678
cometh the said Margaret Hall Exec^rs of the last Will & testament of
the said Walter Hall by Robert Ridgely her Attorney and prayeth her
Execution of the said debt & costs of suite And the said Garret
Van Sweringen according to the warning in this behalfe made by
Robert Carvile his Attorney likewise came And the said Garret
to preclude the said Margarett from her said Execution saith nothing
Therefore itt is considered that the said Margarett shall haue her
Execution against the said Garret Van Sweringen of the debt & costs
aforesaid And also five hundred twenty eight pds of tobacco for her
costs & charges sithence laid out & expended And the Defend^t in
mercy &c
