                    Thomas Ball Thomas Smith late of St Maries County Planter
                        agt was attached to answer unto Thomas Ball in a plea
                    Thomas Smith of trespas upon the case.
                                 And whereupon the said Thomas Ball by Kenelm
                     Cheseldyn his Attorny complaineth that whereas the said Thomas
                     Smith the 27th day of September 1677 Stood indebted unto the said
                     Thomas Smith the summe of fifteen pounds Sterling mony of Eng
                     land and five hundred twenty eight pds of tobacco the said Thomas
                     Smith did assume upon himself e & to the Said Thomas Ball did
                     faithfully promise that he the said Thomas Smith the same when
                     thereunto required would well & truly content & pay notwithstand
                     ing which the Said Thomas Smith the same hath not paid according
                     to his promise but the same to pay hitherto hath & Still doth deny
                     to pay to the damage of the Said Thomas Ball Six thousand pounds
                     of tobacco & thereupon he bringeth his suite
