liberty of speaking hereunto untill next Provinciall Court & itt is Liber N N
granted unto him, the same day is given to the plt also
Now here att this day to witt the Eighteenth day of June in the
third yeare of the Dominion of Charles Lord Baltemore &c Annop
Doni 1678. came the said Edward by Robert Carvile his Attorney
aforesaid & offered himselfe agt the said Bernard Johnson in the
plea aforesaid but the said Bernard although solemnly called came
not but made default Therefore itt is granted by the Court here that
the said pTh recover agt the said Defendt his aforesaid terme yet to
come of & in the Mannor Messuage & land aforesaid with the ap
purtennces And also his damages by occasion of the prmisses sus
tained But because itt is not known to the Court here what damages
the said Edward hath sustained by occasion of the prmisses Itt is
therefore ordered by the Court here that a Writt of Enquiry of
damages issue returneable the next Provinciall Court.
Maryland ss
Tobitha Blanford aged about thirty yeares maketh Oath That
Mrs Letchworth att the tyme that she first (being above five yeares
since) came up the River to forewarne Bernard Johnson of from the
land, she came to the Deponents house & brought Tobias Norton
along with her, & after they had bin there a while, Bernard John
son also came, to whom Mrs Letchworth said, I forewarne you
before W Norton & Wm Mills, off from the land which you live
on, that you may goe now prsently off from itt. Further the said
Deponent saith, that she heard her late Husband Wm Mills deceased
say, that he told Bernard Johnson that he thought there was no land
in the Coscoes to take upp, & that therefore he needed not to putt
himselfe to any charges about itt. Further the said Deponent saith,
that the said Mrs Letchworth with Mr Norton & her said late Hus
band went over the Creek, & her said late Husband att his returne
told her that Bernard Johnson had delivered to Mrs Letchworth
possession of the land in the prsence of the aforesaid Mr Norton &
himself e, & afterwards became Tenant to Mrs Letchworth to whom
he was to pay some corne for rent, & was to plant some trees, but
how many the said Depont cannot call to minde, and further saith
not. Sworne in open Court 12th June 1678.
Roger Brooke of Calvert County gent aged forty yeares or
thereabouts sworne saith
That about twenty five yeares since this Depont lived upon
Aquasco als Brooke Court Mannor being the land in question, &
saith that the Creek called now Tothays Creek on which the Defendt
is now seated was then called Broad Creek being a very broad Creek,
& was then accounted the uppermost bounds of Aquasco Mannor
by the people & his ffather & Servants & every body else that lived
thereabouts.
