402 Provincial Court Proceedings, 1677/8.
Liber N N Doni 1678 came the said parties by their Attorneys aforesaid And
the said Thomas by his said Attorney saith, that he did not assume
upon himselfe & to the said Gilbert faithfully promise in manner &
forme as the said Gilbert in his said declaracon hath suggested & of
this he puts himselfe upon the Countrey, & the plt also Therefore
comand is given to the Sheriffe of St Maryes County that he cause to
come here twelve &c by whom &c who neither &c to recognize &c
because as well &c Att which said seventeenth day of June in the
yeare aforesaid came the said parties by their Attorneys aforesaid
And the jurors impannelled being called likewise came to witt
Thomas Stagg, Benja Hunt, Edmond Dennis, Richard Keen, Robert
Ellys, Edward Turner, Edmond Dermott, Henry Parker, Edward
Cooke, Jno Dickson, Wm Guither & John Baker who being elected
tryed & sworne to say the truth in the prmisses upon their Oaths doe
say that the said Thomas Smith did assume upon himselfe & to the
said Gilbert make such promise as the said Gilbert hath above de
clared agt him Therefore itt is granted by the Court here, that the
said Gilbert Tubervile recover agt the said Thomas Smith as well
the sume of two thousand pds of tobacco by the Jurors aforesaid in
forme aforesaid assessed As also two thousand foure hundred thirty
foure pounds of tobacco costs of suite And the said Tho: Smith in
mercy &c
Charles James Henry Stocket & James Stavely Admrs of Na
agt thaniel Styles late of Cecil County deceased were
Stocket & Stavely Attached to answer unto Charles James of a plea
Admrs Stiles of trespas upon the case
And whereupon the said Charles James by
Christopher Rousby his Attorney complaineth, that whereas the said
Nathaniel Styles in his life tyme to witt the thirtieth day of June
one thousand six hundred seventy six stood indebted to the said
Charles James for tobacco received by the said Nathaniel of sundry
persons for the use of him the said Charles for wheat sold & de
livered to him the said Nathaniel by the said Charles & for ffees due
to him the said Charles a particuler whereof is here in Court pro
duced in all amounting to the sume of Seven thousand nine hundred
& seven pds of tobacco And being so indebted afterwards to witt
the said thirtieth of June one thousand six hundred seventy six in
consideracon thereof did assume upon himselfe & to the said Charles
did faithfully promise that he the said Nathaniel the said sume of
Seven thousand nine hundred ninety seven pounds of tob unto the
said Charles when thereunto required well & truely would pay &
satisfie Yett the said Nathaniel his promise & assumpcon aforesaid
in that behalf e little reguarding but plotting & fraudulently deviseing
him the said Charles wholy to deceive & defraud, the said Seven
p. 628 thousand nine hundred ninety seven Pounds of tobacco in his life
