396 Provincial Court Proceedings, 1677/8.
Liber N N which the said Wm Rosewell the said sume of three thousand pds
of tobacco according to the tenor of the said writeing obligatory
hath not paid to him the said John in his life tyme nor to the said
Tho: Carlisle Jno Watson Robert Graham & Wm Hatton Exrs of the
last Will & testament of the said John Cuningham though often
thereunto required, but the same to pay hitherto hath & still denies
to the damage of them the said Tho: Carlisle John Watson, Robert
Graham & Wm Hatton the sume of five thousand pds of tobacco &
thereupon he bringeth his suite
And the said Wm Rosewell by Robert Carvile his Attorney corn
eth & defendeth the force & injury when &c and prayeth liberty to
imparle hereunto untill next Provinciall Court & itt is granted unto
him, the same day is given to the plts also
Now here att this day to witt the Eighteenth day of June in the
third yeare of the Dominion of Charles Lord Baltemore &c Anoq
Doni 1678. came the said plts by their Attorneys aforesaid & offered
themselves agt the said Wm Rosewell in the plea aforesaid, but the
said Wm came not but made default Therefore itt is considered by
the Court here that the said Thomas Carlisle John Watson Robert
Graham & Wm Hatton Exrs as aforesaid recover agt the said Wm
Rosewell as well the sume of three thousand pds of tobacco debt
As also five hundred & Sixty pds of tobacco costs of suite.
Cuningharns Exrs Thomas Keyting late of St Maryes County other
agt wise called Thomas Keyting of St Michaels Hun-
Thomas Keyting dred planter in St Maryes County in the Prov
ince of Maryland was Sumoned to answer unto
Tho: Carlisle, John Watson, Robert Graham & Wm Hatton Exrs
of the last Will & testament of John Cuningham deceased in a plea
that he render unto them the sume of two thousand nine hundred
& sixty three ptts of tobacco which from them he unjustly detaineth
And whereupon the said Tho: Carlisle John Watson Robt Graham
& Wm Hatton by Kenelm Cheseldyn their Attorney say, that whereas
the said Tho: Keyting the sixteenth day of July in the yeare of our
Lord one thousand six hundred seventy six by his certaine writeing
obligatory sealed with the seale of the said Thomas Keyting here
in Court produced whose date is the same day & yeare above written
did acknowledge himselfe to owe & stand indebted to the said John
Cuningham Mrchant in the full & just Sume of two thousand nine
hundred sixty three pds of good sound Mrchantable tobacco in cask
& that to be paid unto the said John Cuningham his heyres Exrs or
assignes or his lawfull Attorney & that upon all demands after the
tenth day of Octobr next ensueing the date thereof & that in some
convenient landing in the aforesaid Hundred To the true payrnt
whereof he did binde himself e his heyres Exrs Admrs firmly by those
prsents Notwthstanding which the said Tho: Keyting the said sume
