And the said Garret by Robert Carvile his Attorney cometh & Liber N N
defendeth the force & injury when &c and prayeth liberty to imparle
hereunto untill next Provinciall Court & itt is granted unto him,
the same day is given to the plt also
Now here att this day to witt the thirteenth day of June in the
third yeare of the Dominion of Charles Lord Baltemore &c Annocp
Doni 1678 came the said Marke Cordea by Robert Ridgely his said
Attorney And the said Garret in his proper person came also And the
said Garret saith nothing in barre or avoidance of the action afore
said of him the said Marke Cordea whereby the said Marke remain
eth agt the said Garret thereof wholy undefended Therefore itt is
granted by the Court here that the said Marke Cordea recover agt
the said Garret VanSweringen as well the sume of Eight thousand
three hundred sixty two pds of tobacco debt As also five hundred
thirty six ptts of tobacco costs of suite
Marke Cordea Peter Mills late of St Maryes County planter was
agt Attached to answer unto Marke Cordea of a plea
Peter Mills whereforce by force & armes one brown bay Mare of
about five yeares old of the price of three thousand
pounds of tobacco & one stone Colt of about a yeare old of the price
of one thousand pds of tobacco of the proper Goods and Chattells
of the said Marke Cordea att New Towne in the County aforesaid p. 620
lately found, he the said Peter did take away, & them from thence
to the Plantacon of the said Peter in the County aforesaid did lead
away, & the said Mare by rideing & other worke did so over labour
that att the Plantacon of the said Peter aforesaid by his over rideing
& over workeing her she the said Mare dyed, & the said Peter the
said colt to certaine persons unknown did sell to the great dathage
of the said Marke Cordea & agt the peace of the right Honble the Lord
Propry that now is
And whereupon the said Marke Cordea by Robert Ridgely his
Attorney complaineth, that whereas the said Peter Mills the tenth
day of April in the second yeare of the Dominion of Charles &c
Annoq3 Doni 1677. by force & armes one brown bay mare of about
five yeares old of the price of three thousand pds of tobacco, & one
Stone Colt of about a yeare old of the price of one thousand pets of
tobacco of the proper Goods & Chattels of the said Marke Cordea att
Newtown in the County aforesaid lately found he the said Peter
did take away, & the said Mare by rideing & other worke did so over
labour that att the plantacon of the said Peter aforesaid by his over
rideing & over working her she the said Mare dyed, & the said Peter
the said Colt detained in his Plantacon aforesaid And the said Colt to
certaine persons unknown did sell to the great damage of the said
Marke Cordea & agt the peace of the right Honble the Lord Propry
that now is whereupon the said Marke saith he hath losse & is worse
