                  388       Provincial Court Proceedings, 1677/8.

            Liber N N  when he should be thereunto lawfully requested would well & truely
                   content & pay Yet notwithstanding the said George his promise &
                   assumpcon aforesaid little reguarding, but deviseing & fraudulently
                   intending him the said James in this behalfe craftily & subtily. to
                   defraud & deceive, the said George in his life tyme or the said Mor
                   gan since his death the said sume of six thousand eight hundred &
                   sixty pits of tobacco to him the said James though often thereunto
                   required hath not paid or satisfied, but the same to pay & satisfie
                   have hitherto denyed & refused & still doe deny & refuse to the dam
                   age of the said James tenn thousand pds of tobacco & thereupon he
                   bringeth his suite
                    And the said Morgan Jones by Kenelm Cheseldyn his Attorney
                   cometh & defendeth the force & injury when &c & prayeth liberty to
                   imparle hereunto untill next Provinciall Court & itt is granted unto
                   him the same day is given to the plaintiffe also
                    Now here att this day to witt the Eighteenth day of June in the
                   third yeare of the Dominion of Charles Lord Baltemore &c Annocp
                   Doni 1678. came the said James Lewis by his Attorney aforesaid &
                   offered himselfe agt the said Morgan Jones in the plea aforesaid,
                   but the said Morgan came not but made default, therefore itt is
                   granted by the Court here, that the said James Lewis recover agt the
                   Estate of the said George Charlesworth as well the sume of Six thou
                   sand eight hundred & Sixty pds of tobacco damages occasioned by
                   the trespas aforesaid As also Eight hundred thirty two pds of tobacco
                   costs of suite.

                  Symon Reider Garret VanSweringen late of St Maryes County
                      agt otherwise called Garret VanSweringen of the
                 G VSweringen County of St Maryes Innholder was sumoned to
                              Answer unto Symon Reider of the same County
                   and Province in a plea that he render unto him the just quantity of
                   three thousand pounds of good sound Mrchantable tobacco & caske
                   which to him he oweth & unjustly detaineth.
               p.  616 And whereupon the said Symon Reider by Nehemiah Blakiston
                   his Attorney saith, that whereas the said Garret VanSweringen upon
                   the ffifteenth day of Novembr one thousand six hundred seventy six
                   by his certaine bill or writeing obligatory sealed with the seale of
                   him the said Garret & here in Court produced whose date is the day
                   & yeare aforesaid did confesse & acknowledge himself e to be holden
                   & firmly bound unto the said Symon in the full & just Sume of
                   three thousand pds of good sound Mrchantable tobacco & cask in
                   hand to be paid to the said Symon Reider or his certaine Attorney
                   his heyres Exrs & Admrs or assignes upon demand in St Maryes
                   County To the which paymt well & truely to be made, the said Garret
                   did binde himselfe his heyres Exrs & Adrs in the whole & for the whole
                   firmly by those prsents Notwithstanding which the said Garret Van-
