368 Provincial Court Proceedings, 1677/8. Liber N N behalf e to defraud, the said sume though often thereunto requested hath not paid to the said Wm but the same to pay doth altogether deny & refuse Whereupon he saith he is damnified & hath losse to the Value of five thousand pits of ton, & thereupon he bringeth suite And the said Thomas ifolkes by Christopher Rousby his Attorney cometh & defendeth the force & injury when &c & prayeth liberty to imparle hereunto untill next Provinciall Court & itt is granted unto him, the same day is given to the plaintiffe also Now here att this day to witt the Eighteenth day of June in the third yeare of the Dominion of Charles Lord Baltemore &c Annop Doni 1678. came the said Wm Jones by his Attorney aforesaid & offered himselfe agt the said Thomas ifolkes in the plea aforesaid but the said Thomas came not but made default Therefore itt is considered by the Court here, that the said Wm Jones recover agt the said Thomas ffolkes as well the sume of foure thousand seven hundred & six pits of tob damages occasioned by the prmisses As also flue hundred fifty & two pits of tobacco costs of suite Wm Taylor Wm Layton late of Somrsett County agt in Ejectmt planter was Attached to answer unto Wm Wm LaytonTaylor of a plea wherefore by force & Armes one Messuage of One thousand acres of land in the County aforesaid & lately in the tenure & occupa con of Tho: Jones gent! & which the said Thomas Jones to him the said Wm Taylor demised for a terme not yet past did enter & him from his farme aforesaid did Eject & other Enormities to him did doe to the great damage of him the said Wm Taylor & contrary to the peace of the Lord Propry &c And whereupon the said Wm Taylor by Robert Ridgely his At torney complaineth, that whereas the said Thomas Jones the first p. day of May in the second yeare of the Dominion of Charles &c An noq Doni One thousand six hundred seventy seven att Somrsett County aforesaid had Demised to the said Wm Taylor the said Mes suage with the appurtennces called Naseworthys choice lying on the South side of Manokin River & begining att a marked Pyne divideing itt from the land of Wm Glanvile, & from thence runing North East along the river the breadth of One hundred & fifty poles to a marked Oak standing opposite agt a point of land called the tradeing point, & from thence runing South East upon the South side of a small Creek called the upper forke the length of Six hundred & fifty poles to a marked Pyne upon the South side of the Southermost branch of the upper fforke, & from thence South South West the breadth of one hundred & fifty poles to a marked Oak with a line drawn North West the length of six hundred & fifty poles to the first bounder containing by estimacon One thousand acres or thereabout To have & to hold unto the said Wm Taylor & his assignes from the ifeast of |
