350 Provincial Court Proceedings, 1677/8.
Liber N N third yeare of the Dominion of Charles Lord Baltemore &c Annoq3
Dni 1678. came the said parties by their Attorneys aforesaid, & the
said Henry Stocket by George Parker his said Attorney saith, that
in the Record & proces aforesaid & in rendring judgemt aforesaid
itt is in nothing erred, & prayeth that the aforesaid justices doe pro
ceed as well to the examinacon of the Record & proces as to the
aforesaid matter for Errors assigned And the said Robert Peca as
above prayeth likewise. And because the Justices here as of their
Judgemt of & upon the prmisses to render are not as yet advised,
day is thereupon given to the said parties untill the Eighteenth day
of the same month of June.
Att which said Eighteenth day of June in the yeare aforesaid
came the parties aforesaid by their Attorneys aforesaid And here
upon as well the Record & proces aforesaid to the rendring the judgmt
thereupon as the aforesaid causes & matters above by the aforesaid
plaintiffe for Error assigned being seen & by the Justices here more
fully understood & diligently examined And for that itt appeareth to
the same Justices that in the Record & proces aforesaid, as also in the
rendring of judgmt aforesaid itt is manifestly erronious Therefore
itt is considered that the judgemt aforesaid for the Errors in the
Record & proces aforesaid be revoaked adnulled & altogether held
for nothing And that the said Robert Peca unto all things which
he by occasion of the judgemt aforesaid hath lost be restored.

agt dred seventy six came John Howell & Nathaniell
George WellsHowell Exrs of the last Will & testamt of Thomas
Howell deceased by Robert Carvile their At
torney before the Honble Philip Calvert Esqr Chancelour of Mary
land & prayed his Lopps Writt of Error to them the said John &
Nathaniel to be granted to the Comrs of his Lopps County of Cecil
County to be directed to require them the said Comrs to send before
his Lopps Justices of the Provinciall Court the tenour of the Record
proceedings & judgemt of the said County Court in a cause there late
depending att the prosecucãn of George Wells, & itt is granted unto
him, the tenor whereof is as followeth in these words.
Charles absolute Lord & Propry of the Provinces of Maryland &
Avalon Lord Baron of Baltemore &c To the Comrs of Cecil County
greeting Because in ye Record & proces as also in the rendring of
Judgmt agt the Estate of Tho: Howell deceased att the request of
George Wells before you in our said Court of Cecil County manifest
Error hath happened to the great damage of John & Nathaniel
Howell Exrs of the last Will & testamt of the said Thomas Howell,
as by the great complaint of the said John & Nathanll Howell we have
