                   296      Provincial Court Proceedings, 1677/8.

            Liber N N  first abovesaid, did binde himselfe his heyres Exrs Admrs & assignes
                   to pay or cause to be well & truely paid unto Christopher Hassell or
                   his order the full & just Sume of two thousand nine hundred sixty &
                   foure pds of good sound Mrchantable tobacco & caske to be paid
                   on the plantacon where he the said Richard Nash theti lived upon
                   demand, Notwithstanding which the said Richard Nash the said
                   sume of two thousand nine hundred sixty & foure pounds of tobacco
                   to him the said Christopher Hassell according to the said bill Obliga
                   tory although often demanded hath not paid or satisfied, but the
                   same to pay or satisfle hath altogether denyed & refused & still doth
                   deny & refuse to pay the same whereupon the said Christopher Has-
                   sell saith he is damnified & hath losse to the Value of five thousand
                   pounds of tobacco, & thereupon he bringeth his suite.
                     And the said Richard Nash by Robert Ridgely his Attorney corn
                   eth & defendeth the force & injury when &c and prayeth liberty to
                   imparle hereunto untill next Court & itt is granted unto him, the
                   same day is given to both parties.
                     Now here att this day to witt the tenth day of April in the third
                   yeare of the Dominion of Charles Lord Baltemore &c Annocp Doni
                   1678 came the said parties by their Attorneys aforesaid And the said
                   Richard saith, that as to two thousand three hundred Eighty five
                   pounds of tobacco the remainder of the debt aforesaid he cannot
                   gainsay for that he oweth the same unto the said Christopher There
                   fore itt is considered by the Court here, that the said plaintiffe re
                   cover agt the said Defendt the said sume of two thousand three hun
                   dred eighty five pounds of tobacco debt As also six hundred forty
                   foure pds of tobacco costs of suite

                   Henry Stocket & James James Mills late of Baltemore County Exr
                   Stavely Exrs Styles of the last Will & testamt of Samuel Boston
                       agt         deceased was sumoned to answer unto
                   James Mills Exr Henry Stocket & James Stavely Exrs of
                     Sam Bostonthe last Will & testamt of Nathaniel Styles
                     deceased of a plea that he render unto them
                   the sume of fourteen thousand eight hundred & sixty pounds of to
                   bacco in caske which from them he unjustly detaineth
                     And whereupon the said Henry Stocket & James Stavely by
                   George Parker their Attorney say, that whereas the said Samuell
                   Boston the seventeenth day of June in the yeare of our Lord God
                   One thousand six hundred seventy & six, by his bond or writeing
                   obligatory sealed with the Seale of him the said Samuell Boston &
                   here in Court produced whose date is the day & yeare first abovesaid,
                   did owe & stand indebted unto Nathaniel Styles of Cecil County his
                   heyres Exrs Adrs or assignes the sume of fourteen thousand eight
                   hundred sixty pounds of tobacco To the which payment well &
                   truely to be made he the said Samuell Boston did binde himselfe
