Provincial Court Proceedings, 1677/8. 281 John Blakiston And that the said Clement Hill recover agt the said Liber N N John Blakiston the sume of seven hundred thirty three pounds of tobacco for his costs & charges by him above his defence in this behalf e laid out & expended And the said John Blakiston in mercy Tho: Robinson Clement Hill was Attached to Answer unto Thomas agt Robinson in a plea of trespas upon the case. Clement Hill And the said Clement Hill by Kenelm Cheseldyn his Attorney cometh & defendeth the force & injury when &s and prayeth liberty to imparle hereunto untill next Pro vinciall Court & itt is granted unto him, the same day is given to both parties Now here att this day to witt the twelfth day of April in the third yeare of the Dominion of Charles Lord Baltemore &c Annoaj Doni 1678. came the said Clement Hill by his Attorney aforesaid, but the said Thomas Robinson came not but made default There fore itt is considered by the Court here that a Nonsuite be Awarded against the said Tho: Robinson And that the said Clement Hill recover agt the said Tho: Robinson the sume of seven hundred thirty three pounds of tobacco for his costs and charges by him about his defence in this behalfe laid out & expended And the said Tho: Robin son in mercy Aprill 11th 1678 I doe hereby acknowledge satisfaction upon Record of the Judge ment obtained by John & Nathaniel Howell Exrs of Thomas Howell agt George Wells & Johannah Goldsmith. Robert Carvile Att p quer Jno & Nathaniel Thomas Long Sheriffe of Baltemore County was Howell Exrs Tho: Attached to Answer unto John & Nathaniel Howell. Howell Exrs of the last Will & testament of agt Thomas Howell deceased of a plea of trespas of Tho: Long the case. And whereupon the said John & Nathaniel by Robert Carvile their Attorney say, that the said Thomas Long upon the thirteenth day of March One thousand six hundred seventy seven standing justly indebted unto the said John & Nathaniel in the sume of five thousand one hundred ninety three pounds of tobacco, he the said Thomas Long in consideracOn thereof did assume upon him selfe & to the said John and Nathaniel did faithfully promise that he the said Tho: Long the said sume to them the said John & Nathaniel when thereunto required would well & truely satisfie & pay Yet notwithstanding the said Thomas Long the said sume of five thousand one hundred ninety three pds of tob To them the said John 525 & Nathaniel though often thereunto required hath not paid or satis |
