Provincial Court Proceedings, 1677/8. 229 ffebry in the third yeare of his Lordps Dominion &c Annoq Doni Liber N N 1677. doe with the consent of Kenelm Cheseldyn Attorney for the plaintiffe order, that the said John Saunders be remanded to the Sher iffe of Charles County, And that he be not discharged from the cus tody of the said Sheriffe, untill he hath satisfied the said Execucon and given special bayle to Answer the action of John Machen in a plea of debt of foure hundred pounds lawfull money of England Propry Kenelm Cheseldyn Attorney Uen” &c moves for spe agt ciall bayle, whereupon the defendt is comitted into the Wm Crosse j Custody of the Sheriffe of St Maryes County untill he putts in special bayle to Answer the action aforesaid & abide Judgemt Afterwards to witt the nineteenth day of ffebruary in the third yeare of the dominion of Charles Lord Baltemore &c Anncxp Doni 1677. came the said Wm Crosse, & Peter Sayer, & George Robins of Talbott County his suerties acknowledged in open Court & undertooke for him the said Wm Crosse in the sume of two thousand pounds stert to be Levyed of their & each of their Goods & Chattels lands and tenemts to his Lordps use upon this Condicon, that if the said Wm Crosse be cast in this suite, that then the said Wm Crosse shall pay the Condemnacon or deliver himselfe to the prison of the Sheriffe of the County of St Maryes, or they the said Peter Sayer & George Robins will doe itt for hini Nicholas Page, Tho: Comand was given to the Sheriffe of Charles p. 479 Welborne & Compa & at County that he take John Saunders other agt wise called John Sannders of Charles County John Saundersin the Province of Maryland Mrchant if he should be found in his bailywicke & him safe keep, so that he have his body here the twelfth day of April ffebru ary 1677. to Answer unto Nicholas Page Tho: Welborne & Compa & Amos Bonvile in a plea that he render unto them fifty two thou sand pounds of tobacco which to them he oweth & unjustly detaineth Which said twelfth day of ffebruary on which the said Court ought to haue bin held was by his Lordpps writt of Adjournmt adjourned untill the thirteenth day of the same month Att which said thirteenth day of ffebruary the same Sheriffe maketh returne of the writt afore said, that he hath taken the said John Saunders whose body he hath as by the same writt he is required. And the said plaintiffes by Kenelm Cheseldyn their Attorney moved for special bayle, where upon itt is ordered that the said John Saunders remaine in the cus tody of the Sheriffe aforesaid untill he hath given speciall bayle to Answer the action aforesaid & abide Judgemt Marke Cordeal The Sheriffe of St Maryes County haveing returned agt a cepi in this cause, the Defendt informes the Court, ifrances Lucas that by reason of her extream poverty she cannot defend the aforesaid suite, unlesse she be admitted |
