Liber N N Peter Bond & UXr agt James Rigbey Exr Wm Drury Tho: jones These five actions are continued untill next ag April Court David Browne Hannah Hawkins Exx Tho: Hawkins agt Garret VSweringen Joshua Doyne agt Tho: Clipsham Admr Cha: Gregory p. 456 Proprietary Memorandum that att a Provinciall Court held att agt St Maryes the second day of Octobr in the second yeare John Allen of the Dominion of the right Honble Charles &c and in ye yeare of our Lord One thousand six hundred sev enty seven here prsent in Court, Kenelm Cheseldyn Attorney Gen” of the said Lord Propry in his owne proper person who for the said Lord Propry in this behalf e followeth, & exhibitteth to the Court here his certaine Informacon agt John Allen of Charles County gentt thereby giveing the Court here to understand & be in formed That whereas the said John Allen the tenth day of Novembr in the three & fortieth yeare of the Dominion of Caecilius &c and in the yeare of our Lord One thousand six hundred seventy foure, did by his certaine writing Obligatory sealed with the seale of the said John here in Court produced whose date is the same day & yeare above written, did acknowledge himselfe holden & firmly bound unto the right Honble Caecilius absolute Lord and Propry of Maryland aforesaid &c his heyres & Successors in the full & just Sume of forty thousand pounds of good sound Mtchantable leafe tobacco & caske to be paid to the said Lord Propry his heyres Successors or assignes to the which paymt well & truely to be made he did binde himself e his heyres Exrs & Admrs firmly by those prsents Notwithstanding which the said John Allen the said sume of forty thousand pounds of to bacco to the said right Honble Caecilius &c in his life tyme, nor to the said right Honble Charles absolute Lord & Propry of this Province his heyre & Successor since his death according to the tenor of the said Obligation, but the same to pay hitherto hath & still doth deny to pay to the damage of the said Lord Propry fifty thousand pounds of tobacco. Whereupon the said Kenelm Attorney as aforesaid for the said Lord Propry prayeth advice of the Court in the prmisses And that the said John Allen may come here in Court & Answer the said Lord Prop” upon the same |
