                    182      Provincial Court Proceedings, 1677/8.

             Liber N N  tobacco by him the said Tho: Taillor from the said Tho: Pattison
                    received And upon this accompt the aforesaid Tho: Pattison was
                    then & there found in arreares to the said Tho: Taillor the sume
                    of thirteen thousand foure hundred & fifty pounds of tobacco as by
                    the particulars of the said accompt hereunto may appeare. In con
                    sideracon there the said Tho: Pattison did assume upon himselfe &
                    to the said Thomas Taillor faithfully promise, that he the said
                    Thomas Pattison the said Sume of thirteen thousand foure hundred
                    & fifty pounds of tobacco to him the said Thomas Taillor when he
                    should be thereto requested would well & truely content & pay Yet
                    notwithstanding the said Tho: Pattison his promise & assumpcön
                    aforesaid little reguarding, but deviseing & fradulently intending him
                    the said Thomas Taillor in this behalfe craftily & subtily to defraud
                    & deceive, the said sume of thirteen thousand foure hundred & fifty
                    pounds of tobacco or any part thereof to him the said Thomas Taillor
                    though often thereunto requested hath not paid or satisfied, but
                    the same to pay & satisfie hath hitherto altogether denyed & refused
                    & still doth deny & refuse to the damage of the said Thomas Taillor
                    twenty thousand pounds of tobacco & thereupon he bringeth his suite
                    And the said Thomas Pattison by Kenelm Cheseldyn his Attorney
                    cometh & defendeth the force & injury when &c and prayeth liberty
                    of speaking hereunto untill next Court & itt is granted him, the
                    same day is given to the said Tho: Taillor also
                      Now here att this day to witt the two & twentieth day of ffebry
                    in the third yeare of the dominion of Charles Lord Baltemore &c
                    Annoq Doni 1677 came the said parties by their Attorneys afore
                    said, & the said Tho: Pattison saith, that he did not accompt as the
                    plaintiffe above against him hath declared. And the plaintiffe saith
                    he did accompt And of this they putt themselves upon the Countrey
                    Therefore comand is giuen to the Sheriffe of St Maryes County that
                    he cause to come here twelve &c by whom &c, who neither &c to rec
                    ognize &c because as well &c And the Jurors impannelled being called
                    likewise came to witt Tho: Cosden, Tho: Doxey, Henry Phippes,
                    Tho:     Bankes, John Askin, Tho: Potter, Edward Pynn, Richard
                    ifenwick, Philip Lynes, Tho: Keyting, Wm Thomas & Emanuel Rat
                p. 439  cliffe And the said Tho: Taillor by his Attorney aforesaid Said he
                    would make no further prosecution in the plaint aforesaid against
                    the said Thomas Pattison Whereupon itt is granted by the Court
                    here, that the said Thomas Pattison recover against the said Thomas
                    Tailler the sume of pounds of tobacco for his costs &
                    charges by him about his defence in this behalf e laid out & expended
                    And the said Tho: Tailler in mercy for his false claime

                    Wm DeMayer Garret VanSweringen late of St Maryes Citty
                        agt gentl was attached to Answer unto Wm
                  Garret VSweringen    DeMayer Wchant of a plea of trespasse upon
