144 Provincial Court Proceedings, 1677/8. Liber N N Then was William Williams gentt sworne Attorney of this Court ffebruary 23th 1678 Then were John Blomfeild & Wm Crosse gentt admitted & Sworne Attorneys of this Court. Eodem die Ordered by the Court, that the Attorneys of this Court for all such writts as they shall sue out for the future, file their declaracon upon such writt by the last day of the same Court that the writt is retornable, or else the Clerke of the Court is hereby ordered not to receive the same without speciall & particular lycence from this Court And itt is further ordered, that any Attorney appearing for any defendt in this Court shall before the first day of the next Court after such his appearance file his plea with the Clerke of this Court And in case of his default thereof, the Clerke of this Court is hereby ordered not to receive the same without particular order from the Court. And further this Court thinke fitt to resolve, that for default of fileing declaracon according to the above rule the plaintiffe shall suffer a Nonsuite, without he can giue some such sufficient rea son for his not doeing the same as this Court shall approve And further, that for default of fileing a plea according to the above rule Judgemt shall passe against the defendt without he can give some such sufficient reason for his not doeing the same as this Court shall approve And of this all the Officers & Ministers of this Court are to take notice p.406 John Addison & John Ireland Admistr of all & singuler the Rebeccah his wife Goods Chattels rights and creditts which were EXX Tho: Dent of Margarett Penry deceased was Attached to agt Answer unto John Addison & Rebeccah his wife John Ireland Admr Execx of the last will & testament of Thomas Margarett Penroy Dent deceased of a plea of trespas upon the case And whereupon the said John & Rebeccah by Robert Ridgely their Attorney complaine, That whereas the said Margarett in the life tyrne of the said Margarett to witt between the two & twentieth day of June One thousand six hundred seventy foure, & the thirteenth day of August One thousand six hundred seventy foure bought had & received of the said Thomas Dent divers Goods & mrchandizes amounting in the whole to the surne of foure thousand three hun dred & Eight pounds tobacco, a particular whereof is by the said John & Rebeccah here in Court produced In consideracon whereof the said Margarett did assume upon her selfe & to the said Thomas in his life tyme did faithfully promise that she the said Margarett him the said Thomas the said sume of foure thousand three hundred |
