362 Provincial Court Proceedings, 1676. Liber N N Mathias Woods upon an accompt for thirteene hun agt dred & forty pounds of tobacco. Elizabeth Delaroch exrx of these two actions are agreed & or- Charles Delarochdered that each action ballance the other & that the said bill due from the said Mathias Woods for the said summe of One thousand forty six pounds of tobacco be delivered up by the plaintiff Delaroch. To the Honble Charles Calvert Esq Leiut Genrll and and Cheife Governor of Maryland. The humble Petition of John Cocke of Cecil County. Humbly Sheweth unto yr Honr that whereas yr Petitioner had on the 25th of June last past admcon of all and Singular the goods Chattells & debts of ffrancis Barnes late of Cecil County aforesaid deceased by the judge for probate of Wills &c to him committed. And whereas since the Said Admcon W Charles James of the said County hath Seized On the Estate of the said deed as falling due to the Rt Honble the Lord Propry of the said Province of Maryland And whereas yr Petitioner hath been Out very much tobacco in & about the admcon aforesaid besides his Owne reall debt due to him from the said deceased Therefore yr Petitioner humbly prayeth that yr Hour would be pleased to Order the said Charles James to satisfie him his debt due from the said deceased with what Charge he hath been at, in and about the said admcon Otherwise that yr Honr would be pleased to grant that his said admc may continue by yr Honrs Order to the said Charles James to render yr humble petr whatsoever he the said Charles James detaines of the estate of the said deceased. and yr Petr as in duty bound shall for ever pray. I shall not give any answer to the Petition untill Charles James be heard and therefore advise the Petitioner to be at the next Provinciall Court where also the said James will be by Order from me. Charles Calvert. 21th ffebr 1675. Mr James. My Lord comanded me to will you in his name to appeare at st Maries to answer the Petition here above.
